<br />REQUEST FOR COUNCIL ACTION <br />Date: 11/25/2024 <br />Item No.: 7.f. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Consider adoption of ordinances and resolutions establishing zoning, business <br />registration and temporary event regulations for adult-use cannabis and hemp and <br />allowing for summary publications <br />1 <br />2 Background <br />3 The state legislature established Chapter 342 of Minnesota state law, known as the "adult-use cannabis <br />4 law" during the 2023 legislative session. These regulations were revised during the 2024 legislative <br />5 session. Since that time, Minnesota's office of Cannabis Management (OCM) has been established to <br />6 oversee the implementation and regulation of adult-use cannabis. Included in OCM's duties were the <br />7 creation of model ordinances, which cities can use to inform local adult-use cannabis regulations. The <br />8 model ordinance was provided to both the Planning Commission and City Council during previous <br />9 meeting discussions. The legalization of adult-use cannabis followed the 2022 legalization of lower- <br />10 potency hemp. Locally, Roseville has implemented licensing for lower-potency hemp, limited retailers of <br />11 lower-potency hemp to eight, prohibited smoking on City property, and enacted a moratorium on the <br />12 operation of cannabis businesses. <br />13 <br />14 On January 1, 2025, the City's moratorium will expire and the City may start receiving zoning compliance <br />15 requests from the state regarding applications for cannabis business licenses. There is no current- <br />16 estimated timeline of when this will actually occur, however, OCM is anticipating early 2025. In <br />17 preparation, the City has been working, over the last several months, on drafting local ordinances to <br />18 ensure regulation of such businesses is done in a manner that meets local needs. However, state law is <br />19 fairly prescriptive, limiting the city's role in both the regulation of adult-use cannabis and lower potency <br />20 hemp. Locally, Roseville has been developing three different ordinances to address three different <br />21 aspects of adult-use cannabis: 1) zoning, 2) business registration, and 3) temporary events. <br />22 <br />23 To date, the following meeting discussions have occurred surrounding this topic: <br />24 September 4, 2024 Planning Commission <br />25 September 9, 2024 City Council <br />26 October 2, 2024 Planning Commission <br />27 October 21, 2024 City Council <br />28 November 4, 2024 City Council <br />29 November 6, 2024 Planning Commission <br />30 All meeting materials, minutes and video from these discussions can be found on the City's Cannabis <br />31 Regulations webpage. <br />32 <br />33 Zoning Ordinance <br />34 Since the City Council's last discussion on this topic, the Planning Commission held the required public <br />35 hearing on the ordinance imposing zoning regulations on cannabis and hemp uses. No members from <br />36 the public attended or provided testimony. The Commission unanimously recommended approval of the <br />37 ordinance.
