This ordinance is provided as Attachment 1. <br />39 <br />40 In terms of the business registration and temporary events ordinances, the draft ordinances have been <br />41 revised since the Council's last discussion on November 4th. These revisions reflect direction from the <br />42 City Council given at the meeting on November 4th, and consist of the following: <br />43 <br />44 Registration Ordinance <br />45 The definition of school has been revised to make clear both public and private schools are <br />46 included. <br />47 Buffer requirements have been revised to reflect a 100' buffer from a school and daycare and a <br />48 500' buffer from a residential treatment facility. <br />49 A redlined draft of the registration ordinance is provided as Attachment 2 and a clean draft is provided as <br />50 Attachment 3. <br />51 <br />52 Events Ordinance <br />53 The definition of school has been revised to make clear both public and private schools are <br />54 included. <br />55 The language for fees for Special Services has been revised to reflect that the fees will be <br />56 established via the City's Fee Schedule but that the City Manager may require a fee based on <br />57 the estimated costs of the Special Services and that a deposit must be paid at least ten business <br />58 days before the event occurs, with the balance due within 30 days of the event. <br />59 Location restrictions have been revised to reflect that Temporary Cannabis Events cannot be <br />60 held on school property. <br />61 Hours restrictions have been revised to reflect a start time of 7am and a stop time of 10pm. It <br />62 should be noted the Council only discussed a stop time of 10pm, but it was determined that a <br />63 stop time, without a start time, would be confusing, so a start time of 7am is suggested. <br />64 A relined draft of the events ordinance is provided as Attachment 4 and a clean draft is provided as <br />65 Attachment 5. <br />66 <br />67 At this time, staff is unaware of any outstanding issues that need to be addressed within the ordinances <br />68 establishing regulations surrounding adult-use cannabis. Given the regulations must be adopted by <br />69 January 1, 2025, two City Council meetings remain on November 25th and December 2nd. The draft <br />70 ordinances have been posted on the City's website well in advance of the ten-day posting <br />71 requirement. As has been previously discussed, it is likely these ordinances may need to be amended <br />72 from time-to-time to respond to issues that were unknown during the initial adoption discussions, as well <br />73 as to react to legislative changes at the state-level. Recognizing this, staff recommends the City Council <br />74 adopt the ordinances provided in Attachments 1, 3 and 5. Staff is also recommending the Council <br />75 permit publication of ordinance summaries to save on publishing costs. This action requires adoption of <br />76 a resolution that contains the summary, which is provided as Attachments 6 (zoning), 7 (business <br />77 registration), and 8 (temporary events). Summary publications require a 4/5th's vote of the City Council. <br />78 <br />79 Policy Objectives <br />80 To implement the provisions of Minnesota Statutes, Chapter 342, and to authorize the City of Roseville <br />81 to protect the public health, safety, and welfare of Roseville residents by regulating cannabis businesses <br />82 within the legal boundaries of the City of Roseville. To find and conclude such ordinances are <br />83 appropriate and lawful land use regulation for the City of Roseville, that the regulations will promote the <br />84 community's interest in reasonable stability in zoning for now and in the future, and that the provided <br />85 provisions are in the public interest and for the public good. <br />86 <br />87 Equity Impact Summary <br />88 The City of Roseville has a limited role in the regulation of adult-use cannabis.
