89 influence stems from it's zoning authority, which impacts owners of commercial property and business <br />90 owners who intend to run a cannabis business. Decisions surrounding where such businesses may <br />91 locate within the city are based on already established zoning allowances. For example, the <br />92 manufacturing or retail sales of cannabis are allowed in zoning districts that already allow manufacturing <br />93 and retail sales of other goods. Proposed regulation, aside from zoning authority, is being informed by <br />94 existing alcohol and tobacco regulations, which have been established and enforced for decades. <br />95 <br />96 The state will seek zoning compliance certification from the City of Roseville before deciding whether to <br />97 issue a business license for a cannabis business/use. The State Office of Cannabis Management <br />98(OCM) has established a social equity process to help ensure corporations and/or deep-pocketed <br />99 investors cannot monopolize the business of manufacturing and selling cannabis in Minnesota. The <br />100 social equity process established by OCM intends for those who have suffered the most from cannabis <br />101 prohibition will be first in line to benefit from its legalization. <br />102 <br />103 Aside from age-compliance regulation surrounding the retail sale of cannabis, which will be conducted <br />104 locally, under the law OCM is tasked with general licensing enforcement. It should be recognized that <br />105 persons/parties will likely seek enforcement from the City of Roseville but will be burdened by the city's <br />106 lack of standing and referral to OCM, which could result in non-timely response to negative impacts. <br />107 <br />108 The impacts of the legalization of cannabis are not yet known and the City must be prepared to amend <br />109 its regulations as needed to address mitigations within local control, including engaging with affected <br />110 parties within the community on those non-state mandated revisions. The fully completed Equity & <br />111 Inclusion Toolkit is provided as Attachment 9. <br />112 <br />113 Budget Implications <br />114 There are no budget impacts related to the drafting of these ordinances. There are fee implications <br />115 related to retail registration and Temporary Cannabis Events, which have been added to the 2025 Fee <br />116 Schedule. Retail sales of taxable cannabis products are subject to the state and local sales and use tax <br />117 and a 10% gross receipts tax. 20% of cannabis gross receipts tax proceeds are allocated to the local <br />118 government cannabis aid account, where 50% is distributed to counties and 50% is distributed to cities <br />119 in June and December. <br />120 <br />121 Staff Recommendations <br />122 Adopt three ordinances and three resolutions establishing zoning, business registration and temporary <br />123 event regulations for adult-use cannabis and hemp, including allowing for summary publications in lieu of <br />124 the full ordinances. <br />125 <br />126 Requested Council Action <br />127 By motion, adopt three ordinances and three resolutions establishing zoning, business registration and <br />128 temporary event regulations for adult-use cannabis and hemp, including allowing for summary <br />129 publications in lieu of the full ordinances. <br />130 <br />131 Be advised, the resolutions allowing for summary publications require a 4/5th's vote of the Council. <br />132 <br />133 <br />Janice Gundlach, Community Development Director <br />Prepared by: <br />1.
