<br />REQUEST FOR COUNCIL ACTION <br />Date: 3/24/2025 <br />Item No.: 8.a. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Consideration of an appeal to the Board of Adjustments and Appeals <br />pertaining to the determination of an unsafe building by the Building <br />Official for property located at 2401 Prior Avenue N, known as the <br />Norwood Inn <br />1 <br />2 Background <br />3 On March 18, 2025 the City posted a Notice of Condemnation/Prohibited Occupancy at the <br />4 Norwood Inn and Suites, effective March 24, 2025 per Minnesota State Rules 1300.0180, <br />5 Minnesota State Fire Code 110.1 & 110.1.1, and Roseville City Code 906.03.H (see <br />6 Attachment 2). On March 19, 2025 SMP Hospitality LLC, on behalf of property owner <br />7 Percy Pooniwala, filed an appeal application to the Notice of Condemnation/Prohibited <br />8 Occupancy order (see Attachment 3). <br />9 <br />10 On October 15, 2024 City staff conducted an inspection in accordance with the City's Hotel <br />11 Licensing Regulations in Chapter 317 of the City Code. An inspection report dated October <br />12 18, 2024 was hand-delivered to the property noting noncompliance with numerous <br />13 standards. On January 24, 2025, at the request of Ramsey County, City staff inspected the <br />14 property following notification of a water pipe burst that caused damage to multiple units. A <br />15 re-inspection occurred on March 3, 2025 where City staff observed no meaningful progress <br />16 towards correcting any of the items outlined in the inspection report from October <br />17 2024. Further, repairs related to the burst pipe were observed, but those repairs appeared <br />18 to be conducted without required permits or inspections, so it is unknown whether those <br />19 corrections meet minimum standards. Because violations remain that impact fire-rated <br />20 assemblies, including from a fire that occurred on or around March of 2024, the City has <br />21 determined the building is no longer safe for continued occupancy. The City has provided <br />22 five months of time to make the necessary corrections, noting the actual incident that <br />23 caused much of the damage occurred nearly a year ago, yet code deficiencies remain and <br />24 no permits or inquiries have been made to correct these deficiencies. Given these events, <br />25 the City's Building Official has the lawful authority to condemn the building and prohibit <br />26 occupancy under Minnesota State Building Code Section 1300.0180 and Roseville City <br />27 Code Section 906.03.H. <br />28 <br />29 Attachment 1 includes a Resolution upholding the condemnation, which is the staff <br />30 recommendation. This recommendation is based on noncompliance with the previously <br />31 issued inspection reports and because the applicant/owner has not provided any <br />32 information that the decision to condemn was based on incorrectly interpreted rules or code <br />33 intent, that stated codes do not apply, or that requirements were adequately satisfied, <br />Page 1 of 2 <br />Qbhf!24!pg!558 <br /> <br />
