34 which is a requirement of an appeal under City Code Section 906.03.K. Given the owner's
35 lack of response to existing correction orders and their failure to articulate why the
36 condemnation action is unlawful, the City has determined its only available enforcement
37 option is to uphold the Notice of Condemnation/Prohibited Occupancy to ensure the health
38 and safety of the occupants of the building. Should the Council wish to grant the appeal,
39 findings should be articulated for insertion in a revised Resolution.
40
41 Attachment 2 includes the condemnation/prohibited occupancy order, the initial inspection
42 report from October 15, 2024 and the re-inspection notes from March 3, 2025 reflecting no
43 substantive code corrections. Attachment 3 is the completed appeal application and
44 Attachment 4 includes photos taken by the Fire Department regarding the fire that occurred
45 in March of 2024. Extensive damage, including but not limited to the damage caused by
46 the fire that occurred in March of 2024, remains in violation of State Building Code.
47
48 Policy Objectives
49 The implementation of the State Building Code is to ensure public health, safety and
50 welfare insofar as they are affected by the continued occupancy and maintenance of
51 structures and premises.
52
53 Equity Impact Summary
54 Equity impacts have not been evaluated.
55
56 Budget Implications
57 None
58
59 Staff Recommendations
60 Deny the appeal, upholding the revocation of the Certificate of Occupancy, condemnation
61 and order to vacate the building, structures and premises at 2401 Prior Avenue N, effective
62 March 24, 2025.
63
64 Requested Council Action
65 By motion, adopt the Resolution provided as Attachment 1 denying the appeal and
66 upholding the revocation of the Certificate of Occupancy, condemnation and order to
67 vacate the building, structures and premises at 2401 Prior Avenue N, effective March 24,
68 2025 based on findings stated in the Resolution.
69
70 Should the Council wish to grant the appeal, findings of fact that articulate how the
71 applicable codes were incorrectly interpreted, do not fully apply, or have been adequately
72 satisfied by other means should be made for the Resolution.
73
74
David Englund, Building Official
Prepared by:
Janice Gundlach, Community Development Director
1.Resolution upholding condemnation order
Attachments:
2.
