<br /> <br />REQUEST FOR COUNCIL ACTION <br />Date: 5/5/2025 <br />Item No.: 10.e. <br />Department Approval City Manager Approval <br /> <br /> <br />Item Description: Approve Renewal of Joint Powers Agreement with the State of <br />Minnesota and Court Data Services Amendment Agreement <br />1 <br />2 Background <br />3 The Minnesota Bureau of Criminal Apprehension (BCA) requires criminal justice agencies and their legal <br />4 representatives to maintain current agreements to access BCA systems and data through the Criminal <br />5 Justice Data Communications Network (CJDN). These agreements are essential to ensure secure and <br />6 lawful access to criminal justice information. <br />7 In 2018, the City of Roseville entered into a Joint Powers Agreement with the State of Minnesota, <br />8 through the BCA, to provide the City Prosecutor, Erickson, Bell, Beckman & Quinn, access to these <br />9 systems for the purposes of prosecuting criminal offenses on behalf of the City. A Court Data Services <br />10 Subscriber Amendment is also required to allow access to Minnesota court records through the <br />11 Minnesota Court Information System (MNCIS). <br />12 These tools are used to prepare criminal complaints, review criminal history records, and efficiently <br />13 communicate between the Prosecutor’s Office, the Roseville Police Department, and the courts. <br />14 The BCA has notified the City that the current agreements are expiring and must be renewed to maintain <br />15 uninterrupted access. The updated agreements are nearly identical to the existing ones, with the only <br />16 change being a minor revision in the Court Data Services Amendment reflecting updated access <br />17 methods for prosecutors. <br />18 Per Minnesota Statutes §412.201, for statutory cities like Roseville, the Mayor and City Manager must <br />19 sign the agreements. <br />20 The agreements have been reviewed by our prosecuting attorney and our city attorney. <br />21 <br />22 <br />23 Policy Objectives <br />24 Maintaining access to BCA systems and court data is critical to the City's ability to prosecute criminal <br />25 offenses and uphold public safety. Renewing these agreements ensures the Prosecutor’s Office <br />26 continues to receive the data necessary to perform its legal duties efficiently and securely. <br />27 <br />28 Equity Impact Summary <br />29 While this action does not have a direct equity impact, maintaining these agreements helps ensure <br />30 consistent and fair prosecution of crimes.
