35 (1%) of the household’s adjusted gross income, as evidenced by the household’s <br />36 most recent federal income tax return(s) or a sworn affidavit by applicant. <br />37 Note: If an applicant does not meet the hardship determination noted <br />38 above, they may appeal to City Council if the applicant believes that an <br />39 exceptional and unusual circumstance exists that warrants deferment. City <br />40 Council will review on a case by case basis and may determine whether to <br />41 grant such a request and must do so without giving the applicant <br />42 unreasonable preference or advantage over other applicants. <br />43 2. Interest <br />44 o Interest shall be charged on any deferred assessment at a rate equal to the rate <br />45 charged to others on the same assessment roll. <br />46 3.Term and Continuation of Deferral <br />47 o The deferral shall continue for as long as the applicant continues to meet the <br />48 eligibility criteria and occupies the property as their principal residence. <br />49 The deferred assessment, plus applicable interest, shall become immediately <br />o <br />50 payable upon: <br />51 the death of the owner, provided that the spouse is otherwise not eligible; <br /> <br />52 the sale, transfer or subdivision of the property; <br />53 the property losesits homestead status; or <br /> <br />54 the City determines that there would be no hardship to require immediate <br />55 or partial payment. <br />56 o It shall be the duty of the applicant to notify the City Manager of any change in <br />57 her or his status that would affect eligibility for deferral. <br />58 4. Application Process <br />59 Applications must be submitted in writing to the City Manager or their designee <br />o <br />60 on a form provided by the City. <br />61 The City shall review applications and determine eligibility within 30 daysof <br />o <br />62 submission. <br />63 5.
