The City <br />shall be solely responsible for the design and development of all advertising copy, which shall be <br />subject to the Company’s review and approval, which shall not be unreasonably withheld. The <br />City will provide the Company reasonable advance notice for any required announcement. The <br />City may delegate to another governmental entity a portion of the timefor communityand public <br />service announcements, but such delegation shall not make the delegate a beneficiary of this <br />paragraph or otherwise entitle that entity to bring an action to enforce this paragraph. Such <br />enforcement rights shall at all times remain with the City. <br />3. Timing of Announcements. The Company shall deliver the community and <br />public service announcements for the City in the same manner as its paid advertisers would be <br />displayed. The community and public service announcements shall be displayed as twelve- <br />second spots delivered between the hours of 6:00 a.m. and 9:00 p.m. The community and public <br />service announcements shall be incorporated into one of the 8 or 9 rotation segments and shall be <br />displayed every 96 or 108 seconds, or at a similar rotation that correlates with a paid advertiser’s <br />schedule.T he Company shall ensure that the billboard shall be part of the State of Minnesota’s <br />public safety alert system. TheCompany shall coordinatewith lawenforcement and emergency <br />management authorities to display, when appropriate, regional emergency information important <br />to the traveling public including, but not limited to “Amber Alerts” or emergency management <br />information. Regional emergency information shall be displayed in accordance with the <br />established protocols of local and state authorities. Emergency communications shall travel <br />through established protocols set up by the division of emergency management or first <br />responders. The display of these public safety and emergency announcements shall not count <br />toward the civic community and public service messaging otherwise covered under this <br />Agreement. <br />2 <br />Qbhf!267!pg!385 <br /> <br />
