Minnesota Statute 326B.121, Subd. 2 (c) states that “A municipality <br />must not by ordinance, or through development agreement, require building code provisions <br />regulating components or systems of any structure that are different from any provision of the State <br />Building Code.”https://www.revisor.mn.gov/statutes/cite/326b.121 This portion of the statute <br />does allow for a property maintenance code. It also allows a local municipality to modify foundation <br />requirements due to specific geological formations, like Woodbury having deeper foundation <br />requirements because of their clay deposits. <br />I have read through the section that your city council is interested in adopting and believe it merits <br />incorporation into the State Building Code. Although technically your city council can’t adopt an <br />ordinance for something specifically addressed by the State Building Code (even through deletion) <br />due to statutory prohibition, I will submit a Code Change Proposal to the Residential Building Code <br />Technical Advisory Group and we can very likely get the language incorporated into the next <br />generation of Minnesota Residential Code.
