ATTACHMENT 2
Hi Greg,
I have been asked to get a formal response related to our phone conversation last week (or maybe
the week before?).
An HOA within the City of Roseville (Enclave Development – McCarrons Place near Lake McCarrons)
has made a request to the City Council to adopt two sections of State Code that specifically deleted
from the State Residential Code. Specifically, MSBC 1803.5.7,3307.1 and
Minneapolis Ordinance 89.30 (10)
“(10) Protection of adjoining property. Adjoining property shall be protected from damage during
any construction work on the permit site. Excavations for any purpose shall not remove lateral
support from any footing or foundation without first protecting the footing or foundation against
settlement or lateral translation. The city may require the submission of a soils investigation report
and/or shoring plan.”
From our conversation, Chapter1 of the State Building Code is very clear that the State Code
supersedes any City building regulation. In addition, should the City wish to move forward with
regulations that are more strict (E.g. Minneapolis Code 89.30), the City would have to petition and
receive approval from DLI for such a regulation or requirement.
I apologize for bringing this back to you, but this is going to be presented at a Council meeting in June
and I wanted to be able to articulate clearly the position of the State.
Thanks again for all your help and time on this,
Dave
Dave Englund | Building Official
Community Development Department
Phone: 651.792.7087
david.englund@cityofroseville.com
2660 Civic Center Drive | Roseville, MN 55113
Facebook | Twitter | YouTube
Qbhf!25!pg!322
