ATTACHMENT 2 <br />Hi Greg, <br />I have been asked to get a formal response related to our phone conversation last week (or maybe <br />the week before?). <br />An HOA within the City of Roseville (Enclave Development – McCarrons Place near Lake McCarrons) <br />has made a request to the City Council to adopt two sections of State Code that specifically deleted <br />from the State Residential Code. Specifically, MSBC 1803.5.7,3307.1 and <br />Minneapolis Ordinance 89.30 (10) <br />“(10) Protection of adjoining property. Adjoining property shall be protected from damage during <br />any construction work on the permit site. Excavations for any purpose shall not remove lateral <br />support from any footing or foundation without first protecting the footing or foundation against <br />settlement or lateral translation. The city may require the submission of a soils investigation report <br />and/or shoring plan.” <br />From our conversation, Chapter1 of the State Building Code is very clear that the State Code <br />supersedes any City building regulation. In addition, should the City wish to move forward with <br />regulations that are more strict (E.g.
