interest. An organizational conflict of interest exists when, because of existing or planned <br />activities or because of relationships with other persons, <br /> <br />1. a Responder is unable or potentially unable to render impartial assistance or advice to <br />the City; <br />2. the Responder’s objectivity in performing the contract work is or might be otherwise <br />impaired; or <br />3. the Responder has an unfair competitive advantage. <br /> <br />If after award, an organizational conflict of interest is discovered, an immediate and full <br />disclosure in writing must be made to the Owner’s Representative, which must include a <br />description of the action which the Responder has taken or proposes to take to avoid or <br />mitigate such conflicts. If an organizational conflict of interest is determined to exist, the City <br />may, at its discretion, cancel the contract. In the event the Responder was aware of an <br />organizational conflict of interest prior to the award of the contract and did not disclose the <br />conflict to the Owner’s Representative, the City may terminate the contract for default. <br />Organizational conflicts of interest terms apply to any subcontractors for this work to be <br />performed, and the terms “Contract,” “Responder,” and “Contracts Administrator” modified <br />appropriately to preserve the City’s rights. <br /> <br />4. Evaluation and Negotiation Process <br />4.1. Evaluation of Proposals and the Selection Process <br />The City will review each proposal submitted in response to this RFP for completeness, <br />signatures, and all required data before considering the proposal for further review. See RFP <br />Attachment C with required responses to be submitted and scored. Late responses will not be <br />considered. The City will evaluate proposals against the evaluation criteria by weight given to <br />each. Your firm will be invited to give an interview, which will be scheduled as part of the <br />evaluation. The City will notify you of the exact time and location.
