Each Proposal must include information with respect to <br />each of the evaluation criteria requested in the RFP, as further described in the Attachments. <br /> <br />4.2. Interview and Contract Negotiation <br />As part of the selection process, only up to the top three scoring RFP Respondents will be <br />required to give an interview. Respondents should be prepared to discuss and substantiate any <br />of the responses to the RFP they have submitted and any other area of interest relative to their <br />proposals. Respondents must have their proposed Project Manager and Project <br />Superintendent in attendance at the interview. Other key project team members shall <br />attend as appropriate or requested in Attachment C 3.1 of the RFQ. Proposers will be allowed <br />to give a 30-minute presentation prior to staff asking questions, which is planned for an <br />additional 30 minutes. <br /> <br />After the completion of all interviews, the firms will be evaluated and ranked according to their <br />scores. The Committee will recommend to the City Council that Contract negotiations with the <br />Construction Manager at Risk achieving the highest score shall commence. The selected <br />Construction Manager will be required to enter into a contract that substantially contains the <br />terms and conditions of this RFP and its attachments including the A133 and A201 contract <br />documents, as modified. When the review, scoring and selection/negotiation process is <br />completed with a final, executed Contract, the awarded Responder will be made public. <br /> <br />4.3. Award <br />The award of this solicitation will be negotiated and based upon the total accumulated points <br />as established in the RFP. The City will make its selection based on best value, as determined <br />by the RFQ and the RFP evaluation process. The City reserves the right to pursue negotiations <br />on any exception taken to the City’s proposed Contract terms and conditions. In the event that <br />negotiated terms cannot be reached, the City reserves the right to terminate negotiations and <br />begin negotiating with the next highest scoring Responder or take other actions as the City <br />deems appropriate. The final award decision will be made by the City Council based on the <br />recommendation of the Selection Committee; provided, however, that the City Council is not <br />bound by the recommendation of the Selection Committee. <br /> <br />5. Proposed Contract <br />This Request for Proposal does not commit the City to award any Contract or to pay any costs <br />incurred by the Respondents.
