Attachment 1 <br />44 55401. Notice to the City shall be mailed to the City Manager, 2660 Civic Center Drive, <br />45 Roseville, Minnesota, 55113. Any party may change its respective address for the purpose <br />46 of this Ordinance by written notice to the other parties. <br />47 <br />48 Public Ground.Land owned or otherwise controlled by the City for park, open space or <br />49 similar public purpose, which is held for use in common by the public and not a Public <br />50 Way. <br />51 <br />52 Public Way.Any public right-of-way within the City as defined by Minnesota Statutes, <br />53 Section 237.162, subd. 3. <br />54 <br />55 Section 2. ADOPTION OF FRANCHISE. <br />56 <br />57 2.1. Grant of Franchise. The City hereby grants the Company, for a period of twenty <br />58(20) years from the date this Ordinance is passed and approved by the City, the right to <br />59 transmit and furnish electric energy for light, heat, and power for public and private use <br />60 within and through the limits of the City as its boundaries now exist or as they may be <br />61 extended in the future. For these purposes, the Company may construct, operate, repair, <br />62 and maintain electric facilities in, over, under and across the Public Grounds and Public <br />63 Ways of the City, subject to the provisions of this Ordinance. The Company may do all <br />64 reasonable things necessary or customary to accomplish these purposes, subject, however, <br />65 to such reasonable regulations as may be imposed by the City pursuant to ordinance and to <br />66 the further provisions of this franchise agreement. <br />67 <br />68 2.2. Effective Date:; Written Acceptance. This franchise shall be in force and effect <br />69 from and after the passage of this Ordinance and publication as required by law and its <br />70 acceptance by the Company. If the Company does not file a written acceptance with the <br />71 City within sixty (60) days after the date the City Council adopts this Ordinance, the City <br />72 Council by resolution may revoke this franchise, seek its enforcement in a court of <br />73 competent jurisdiction or pursue other remedies in law or in equity. <br />74 <br />75 2.3. Service, Rates and Area. The service to be provided and the rates to be charged by <br />76 the Company for electric service in City are subject to the jurisdiction of the Commission. <br />77 The area within the City in which the Company may provide electric service is subject to <br />78 the provisions of Minnesota Statutes, Sections 216B. 37 - 40. <br />79 <br />80 2.4. Publication Expense. The City shall pay the expense of publication of this <br />81 Ordinance and shall be reimbursed by Company. <br />82 <br />83 2.5. Dispute Resolution. If either party asserts that the other party is in default in the <br />84 performance of any obligation hereunder, the complaining party shall notify the other party <br />85 of the default and the desired remedy.
