§6.2.5 The Owner and each Separate Contractor shall have the same responsibilities for cutting and patching as are described
<br />for the Contractor in Section3.14.
<br />§6.3Owner’sRighttoCleanUp
<br />If a dispute arises among the Contractor, Separate Contractors, and the Owner as to the responsibility under their respective
<br />contracts for maintaining the premises and surrounding area free from waste materials and rubbish, the Owner may clean up
<br />and the Architect will allocate the cost among those responsible.
<br />ARTICLE7 CHANGESINTHEWORK
<br />§7.1 General
<br />§7.1.1 Changes in the Work may be accomplished after execution of the Contract, and without invalidating the Contract, by
<br />Change Order, Construction Change Directive or order for a minor change in the Work, subject to the limitations stated in this
<br />Article 7 andelsewhere in the Contract Documents.
<br />§7.1.2 A Change Order shall be based upon agreement among the Owner, Contractor, and Architect. A Construction Change
<br />Directive requires agreement by the Owner and Architect and may or may not be agreed to by the Contractor. An order for a
<br />minor change in the Work may be issued by the Architect alone.
<br />§7.1.3 Changes in the Work shall be performed under applicable provisions of the Contract Documents. The Contractor shall
<br />proceed promptly with changes in the Work, unless otherwise provided in the Change Order, Construction Change Directive,
<br />or order for a minor change in the Work.
<br />§7.2 Change Ordersand Change Proposals
<br />§7.2.1 A Change Order is a written instrument prepared by the Architect and signed by the Owner, Contractor, and Architect
<br />stating their agreement upon all of the following:
<br />.1 The change in the Work;
<br />.2 The amount of the adjustment, if any, in the Contract Sum; and
<br />.3 The extent of the adjustment, if any, in the Contract Time.
<br />§7.2.2 The Contractor must submit Change Proposals to the Architect covering a contemplated Change Order within ten (10)
<br />days after request of the Owner, or the Architect or within twenty-one (21) days of the event giving rise to the Contractor’s
<br />claim for a change in the Contract Sum or Contract Time. No increase in the Contract Sum or extension of the Contract Time
<br />will be allowed for the cost or time involved in making Change Proposals. Change Proposals will define or confirm in detail
<br />the Work which isproposed to be added, deleted, or changed and must include any adjustment which the Contractor believes
<br />to be necessary in (i) the Contract Sum, or (ii) the Contract Time. Any proposed adjustment must include detailed
<br />documentation including, but not limited to: cost, properly itemized, including unit prices and quantities where applicable, and
<br />supported by sufficient substantiating data to permit evaluation including cost of labor, materials, supplies and equipment,
<br />rental cost of machinery and equipment,additional bond cost, plus a fixed fee for profit and overhead (which includes office
<br />overhead and Site-specific overhead and general conditions). The Subcontractor’s or Sub-subcontractor’s overhead and profit
<br />in turn must not exceed a total aggregate of ten percent (10%). Change Proposals will be binding upon the Contractor and may
<br />be accepted or rejected by the Owner in its discretion.
<br />§7.2.3 If the Owner determines that a Change Proposal is appropriate, the Architect will prepare and submit a request for a
<br />Change Order or Contract Amendment providing for an appropriate adjustment in the Contract Sum or Contract Time, or
<br />both, for further action by the Owner. No such change is effective until the Owner, Contractorand Architect sign the Change
<br />Order.
<br />§7.3 Construction Change Directives
<br />§7.3.1 A Construction Change Directive is a written order prepared by the Architect and signed by the Owner and Architect,
<br />directing a change in the Work prior to agreement on adjustment, if any, in the Contract Sum or Contract Time, or both. The
<br />Owner may by Construction Change Directive, without invalidating the Contract, order changes in the Work within the
<br />general scope of the Contract consisting of additions, deletions, or other revisions, the Contract Sum and Contract Time being
<br />adjusted accordingly.
<br />§7.3.2 A Construction Change Directive shall be used in the absence of total agreement on the terms of a Change Order.
