Attachment 1 <br />130 the Public Ground to as good a condition as formerly existed and shall maintain any paved <br />131 surface in good condition for one year thereafter. All work shall be completed as promptly <br />132 as weather permits, and if the Company shall not promptly perform and complete the work, <br />133 remove all dirt, rubbish, equipment and material, and put the Public Ground in the said <br />134 condition, the City shall have, after demand to the Company to cure and the passage of a <br />135 reasonable period of time following the demand, but not to exceed five days, the right to <br />136 make the restoration of the Public Ground at the expense of the Company. The Company <br />137 shall pay to the City the cost of such work done for or performed by the City. This remedy <br />138 shall be in addition to any other remedy available to the City for noncompliance with this <br />139 Section 3.3. <br />140 <br />141 3.4. Shared Use of Poles. The Company shall make space available on its poles or <br />142 towers for City fire, water utility, police or other City facilities upon terms and conditions <br />143 acceptable to Company whenever such use will not interfere with the use of such poles or <br />144 towers by the Company, by another electric utility, by a telephone utility, or by any cable <br />145 television company or other form of communication company. In addition, the City shall <br />146 pay for any added cost actually incurred by the Company because of such use by City. <br />147 <br />148 3.5. Avoid Damage to Electric Facilities. The Company, in accordance with current <br />149 standards and regulations, must take reasonable protective measures when the City <br />150 performs work near Electrical Facilities, if given reasonable notice by the City of such <br />151 work prior to its commencement. Nothing in this Ordinance relieves any person, including <br />152 Company, from liability arising out of the failure to exercise reasonable care to avoid <br />153 damaging Electric Facilities while performing any activity. <br />154 <br />155 3.6. Notice of Improvements to Streets. The City must give the Company reasonable <br />156 written Notice of plans for improvements to Public Ways or Public Grounds where the City <br />157 has reason to believe that Electric Facilities may affect or be affected by the improvement. <br />158 The notice must contain: (i) the nature and character of the improvements, (ii) the Public <br />159 Ways and Public Grounds upon which the improvements are to be made, (iii) the extent of <br />160 the improvements, (iv) the time when the City will start the work, and (v) if more than one <br />161 Public Way or Public Ground is involved, the order in which the work is to proceed. The <br />162 notice will be given to the Company a sufficient length of time, considering seasonal <br />163 working conditions, in advance of the actual commencement of the work to permit the <br />164 Company to make any additions, alterations or repairs to its Electric Facilities the Company <br />165 deems necessary. <br />166 <br />167 3.7. Mapping Information. The Company must promptly provide complete mapping <br />168 information for any of it underground Electric Facilities in accordance with the <br />169 requirements of Minnesota Rules, parts 7819.4000 and 7819.4100. Any mapping <br />170 information so provided shall be treated as protected nonpublic data, not public data, trade <br />171 secret information and security information, as is protected from public or unauthorized <br />4 <br />Qbhf!214!pg!384 <br /> <br />
