According to the proposed preliminary plat <br />11 included with this RCA as Attachment 3, about 1.5 acres would be dedicated for County Road D right-of- <br />12 way, 2.25 acres would platted as Lot 1, Block 1, of the Langton Shores Outlots plat, and the remaining <br />13 11.5 acres would be platted as an outlot until such time as it is re-platted as a developable lot for <br />14 construction of potential future additional phases of the Langton Shores care facility. Subdivision <br />15 proposals resulting in three or fewer lots are considered minor plats, requiring the City Council to hold <br />16 the public hearing (unlike a major plat that requires the Planning Commission to hold the public hearing). <br />17 <br />18 Legislative Authority <br />19 When considering subdivision requests, the role of the City is quasi-judicial; to determine the facts <br />20 associated with a particular proposal and apply those facts to the legal standards contained in the <br />21 ordinance and relevant state law. In general, if the facts indicate the application meets the relevant legal <br />22 standards and will not compromise the public health, safety, and general welfare, then the applicant is <br />23 likely to be entitled to the approval. The City is, however, able to add conditions to a subdivision <br />24 approval to ensure that potential impacts on parks, schools, roads, storm sewers, and other public <br />25 infrastructure on and around the subject property are adequately addressed. Subdivisions may also be <br />26 modified to promote the public health, safety, and general welfare, and to provide for the orderly, <br />27 economic, and safe development of land, and to promote housing affordability for all levels. <br />Page 1 of 3 <br />Qbhf!98!pg!384 <br /> <br />
