Attachment 3 <br />1 City of Roseville <br />2 ORDINANCE NO. _______ <br />3 <br />4 AN ORDINANCE AMENDING TITLE I TO ESTABLISH <br />5 SECTION 112 ENTITLED “USE OF CITY RESOURCES.” <br />6 <br />7 THE CITY OF ROSEVILLE ORDAINS: <br />8 <br />9 SECTION 1: Title I, Section 112 of the Roseville City Code is hereby created to <br />10 read as follows: <br />11 <br />12 1120.01. General city services. To the extent permitted by law, in determining eligibility <br />13 for, and providing general city services, city employees shall be governed by the <br />14 following requirements: <br />15 (a)Other than when required by law, city employees, representatives, and <br />16 contractors shall not use city resources, city facilities, property, moneys, <br />17 equipment, data, technology (e.g. license plate recognition, surveillance <br />18 video, computers) ("city resources") or city personnel for the purpose of <br />19 enforcing federal immigration laws. Data subject to 8 U.S.C. §§ 1373 and <br />20 1644 are exempt from this provision. <br />21 (b)No city officer or employee should inquire into the immigration status of <br />22 any person or request any documents or information verifying the <br />23 immigration status of any individual, unless required to do so by law. City <br />24 employees are to carry out their regular duties for the purpose of <br />25 administering general city services and programs. Employees may complete <br />26 1-9 forms, may question a person regarding the 1-9 form and documents <br />27 supporting the 1-9 form, and may a comply with demands by the federal <br />28 government to audit the 1-9 forms as allowed by law. <br />29 (c)City employees shall follow general city, state and federal guidelines to <br />30 assess eligibility for services. City employees shall only solicit immigration <br />31 information or inquire about immigration status when specifically required <br />32 to do so by law or program guidelines. Information about immigration status <br />33 in the possession of the city shall not be maintained or recorded except as <br />34 otherwise specifically required by law. Such information shall be protected <br />35 and disclosed as required by Minnesota Government Data Practices Act. <br />36 <br />37 112.02. Access to property, signage. <br />38 (a)City-owned or city-controlled parking lots, vacant lots, and garages are not <br />39 open to the general public without restrictions.
