Attachment 3 <br />40 federal, state, or local government entity, is authorized to use any city- <br />41 owned or city-controlled parking lot , vacant lot, or garage as a staging area, <br />42 processing location, operations base, or any other similar use including for <br />43 enforcing federal immigration laws, without the consent of the city. <br />44 "Staging area" means an area that is used to assemble, mobilize, and/or <br />45 deploy vehicles, equipment, or materials, and related personnel, for the <br />46 purpose of carrying out operations for the enforcement of federal <br />47 immigration laws. The City will post signs consistent with this section. <br />48 (b) Non-public city spaces are areas owned or controlled by the city that are not <br />49 accessible to the general public. Non-public city spaces may not be used for <br />50 non-city purposes, including the enforcement of federal immigration laws. <br />51 City employees do not have the legal authority to consent to or permit access <br />52 to non-public city spaces in situations where a judicial warrant or other legal <br />53 obligation would otherwise be necessary to gain access. <br />54 <br />55 112.03. Departmental reporting. Any city employee who has an interaction with <br />56 representatives of the Department of Homeland Security related to their enforcement of <br />57 federal immigration laws must report to the to the City Manager as soon as reasonably <br />58 possible, using the format approved by the City Manager. <br />59 112.04. Compliance with federal law. Nothing in this chapter shall be construed to <br />60 violate federal law. The City and its departments and employees will comply with federal <br />61 law including 8 U.S.C.§§ 1373 & 1644. <br />62 112.05. Subpoena or other legal obligation. Nothing in this chapter prohibits city <br />63 employees from responding to a properly issued judicial subpoena, other compulsory legal <br />64 process, or a data request when and to the extent that a response is required by law. <br />65 <br />66 SECTION 2: Incorporation. City staff is authorized and directed to update the table <br />67 of contents, reformat this ordinance, and to make such other non-substantive <br />68 changes, including correcting scrivener’s errors, as are necessary to incorporate the <br />69 amendments adopted by this ordinance into the Roseville City Code. <br />70 <br />71 SECTION 3: Effective date.
