<br />REQUEST FOR COUNCIL ACTION <br />Date: 1/26/2026 <br />Item No.: 10.i. <br />Department ApprovalCity Manager Approval <br />Item Description:Adopt a Resolution approving motor vehicle repair as a Conditional Use for <br />Roseville Automotive, 2150 Hamline Avenue <br />1 <br />2 Background <br />3 Legislative Authority <br />4 When considering Conditional Use requests, the role of the City is quasi-judicial; to determine the facts <br />5 associated with a particular proposal and apply those facts to the legal standards contained in the <br />6 ordinance and relevant state law. In general, if the facts indicate the application meets the relevant legal <br />7 standards and will not compromise public health, safety, and general welfare, then the applicant is likely <br />8 to be entitled to the approval. The City is, however, able to add conditions to a Conditional Use approval <br />9 to ensure that potential impacts on parks, schools, roads, storm sewers, and other public infrastructure <br />10 on and around the subject property are adequately addressed. <br />11 <br />12 Background <br />13 On January 29, 2024, the City Council approved a Zoning Code text change in support of allowing <br />14 “motor vehicle repair, auto body shop” as a Conditional Use (CU) in the Neighborhood Mixed-Use (MU- <br />15 1) district. This text amendment to Table 1005-2 changed “motor vehicle repair, auto body shop” from a <br />16 prohibited use to a CU in the MU-1 district. <br />17 <br />18 Scott Beitz is a prospective buyer of Roseville Automotive located at 2150 Hamline Avenue and has filed <br />19 an application for CU consideration. The property, located at the southeast corner of Hamline and <br />20 County Road B, was originally constructed in 1954 and has always been an automobile service station <br />21 and is therefore permitted to operate given the use was established prior to current CU requirement. <br />22 <br />23 However, Mr. Beitz intends to grow the business by constructing additional service bays to keep pace <br />24 with the growth of his business. Given the current CU requirement, this addition/business expansion <br />25 requires consideration and approval of a CU. The proposed 52-foot by 30-foot addition to the south side <br />26 of the existing service station required a 17.5-foot variance to the 20-foot minimum side yard <br />27 setback. The variance was approved by the Variance Board (2-1) on December 3, 2025, and has gone <br />28 into effect since no appeal of the approval was received. The CU request, including plans for the <br />29 proposed addition, are detailed in the Request for Planning Commission Action provided as Attachment <br />30 1. <br />31 <br />32 This request mirrors a similar request made by another automotive repair business located on the <br />33 opposite corner of this same intersection of County Road B and Hamline Avenue. <br />34 <br />35 Policy Objectives <br />36 The regulations provided in the Zoning Code intend to govern the use of all land and structures within <br />37 the City. <br />38 <br />39 Equity Impact Summary <br />Page 1 of 2 <br />Qbhf!213!pg!277 <br /> <br />
