Page 2 This task assumes two (2) revisions of the EAW based on City comments. Additional reviews and revisions to the document would be considered an additional service. Once approved by the City, documents will be prepared for final distribution. Task 1.3 EAW Distribution and Final Documentation Kimley-Horn will provide final electronic copies (Word document and .pdf) of the EAW to the City for signature and Kimley-Horn will distribute the EAW and all supporting documentation to all entities listed on the most current version of the MnEQB EAW Distribution List and submission to the EQB for publication in the EQB Monitor. It is assumed that Kimley-Horn will prepare and the City will distribute the required public notice of the availability of the EAW for distribution to at least one local newspaper and on the cityÓs website for notices in the project area. Comments on the EAW will be collected by the City, and Kimley-Horn will assist with response to comments. Kimley-Horn will present results of the public comment period and any response to comments to the City Council. Kimley-Horn will also prepare the Adequacy Determination and Finding of Fact and Conclusions (FOFC) for adoption and ultimate distribution and will present to the City Council for final approval. The City will review and provide input to the Adequacy Determination and FOFC, as needed. SERVICES NOT INCLUDED Other services not included in this Agreement: Preparation of materials for and/or attendance at public meetings. ADDITIONAL SERVICES Any services not specifically provided for in the above scope will be billed as additional services and performed at our then current hourly rates following receipt of written approval from City staff. INFORMATION PROVIDED BY CLIENT We shall be entitled to rely on the completeness and accuracy of all information provided by the City or the CityÓs consultants or representatives. The City shall provide all information requested by Kimley-Horn during the project, including but not limited to the following: An executed copy of this agreement Project information and proposed project plans Prior environmental studies for the area (if available) All metrics to be included in the EAW. The metrics will be finalized prior to drafting the EAW. Changes to metrics after Kimley-Horn begins to prepare the draft the EAW could result in a delay in submittal or out of scope work. SCHEDULE Kimley-Horn will provide services as expeditiously as practicable to meet a mutually agreed upon schedule as outlined below.
