Plans submitted in support of the proposal are included with this RCA in Attachment <br />13 3. Subdivision proposals resulting in three or fewer lots are considered minor plats, requiring the City <br />14 Council to hold the public hearing (unlike a major plat that requires the Planning Commission to hold the <br />15 public hearing). <br />16 <br />17 Legislative Authority <br />18 When considering subdivision requests, the role of the City is quasi-judicial; to determine the facts <br />19 associated with a particular proposal and apply those facts to the legal standards contained in the <br />20 ordinance and relevant state law. In general, if the facts indicate the application meets the relevant legal <br />21 standards and will not compromise the public health, safety, and general welfare, then the applicant is <br />22 likely entitled to approval. The City is, however, able to add conditions to a subdivision approval to <br />23 ensure that potential impacts on parks, schools, roads, storm sewers, and other public infrastructure on <br />24 and around the subject property are adequately addressed. Subdivisions may also be modified to <br />25 promote the public health, safety, and general welfare, and to provide for the orderly, economic, and <br />26 safe development of land, and to promote housing affordability for all levels. <br />27 <br />Page 1 of 3 <br />Qbhf!45!pg!2:7 <br /> <br />
