<br />-3- <br /> <br />Subject to Rice street and Little Canada Road, the West <br />138.72 feet of the South 208.72 fxet of the North 894.11 <br />feet of the SW-l/4 of Section 6, Township 29, Range 22 ~ <br />Ramsey County, state of Minnesota; and <br /> <br />WHEREAS, said real estate is located adjacent to but not within <br />the Village of Roseville, said real estate is separated from the Village <br />Limits by Rice Street; and <br /> <br />WHEREAS, the OWNERS desire to use the Roseville Sanitary Sewer <br />System for the land described above; and <br /> <br />WHEREAS, the property owners wi thin the Village of Roseville are <br />subject to special assessments, ad valorem taxes and connection charges <br />to finance the Roseville Sanitary Sewer System and said OWNERS have never <br />contributed by way of taxes to any such System; and <br /> <br />WHEREAS, the OWNERS are willing to pay to the VILLAGE the sum of <br />$2,500.00 in lieu of any special assessments, ad valorem taxes and <br />connection charges; and <br /> <br />WHEREAS, the Village Engineer has investigated the land above- <br />mentioned and has advised the Village Council that the sum of $2,500 <br />is a fair and equitable amount of money to represent the ::pecial assess- <br />ment, ad valorem. tax and connection charge by the OWNERS and has <br />dvised the Village of Roseville that the Roseville Sanitary Sewer System <br />nas adequate capacity to service the above-mentionedland,l) <br /> <br />NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES AS roLLOWS~ <br /> <br />I. <br /> <br />1. The OWNERS agree that they will secure all necessary permits <br />from any authority necessa~ to facilitate the sewer connection as <br />herein contemplated, including the City of Saint Paul and Minneapolis~ <br />st. Paul Sanitary District. <br /> <br />2. The OWNERS further agree that in the event they fai.l to secure <br />any necessa~ permit$ this Agreement shall be null and void, and the <br />VILI;AGE shall no t be obligated to furnish sewer servi ce to the OWNERS 9 <br />and the OWNERS agree in that event they will pay to the VILLAGE all costs <br />incurred by the VIILAGE in engineering and 18 gal expenses in this <br />transaction. <br /> <br />3.. The OWNERS agree that the entire plans for the construction of <br />said sewer service shall be subject to the inspection and approval of <br />the Village Engineer and agree further that the Village Engineer may <br />require an indemnity bond by the OWNERS at his discretion for any damages <br />to the Roseville Sanitary Sewer System.. <br /> <br />4. The OWNERS agree that they will comply with all the Ordinances <br />/f the Village Code of the Vill...ge of Roseville which relate to the <br />Sanitary Sewer System, both relating to the construction of said sewer <br />connection and the use o.f said sewer after the compJ.e tion of the <br />constructiono <br /> <br />VITALE <br />SEWER <br />CONNECTION <br />(CONTiDo) <br />
