<br />4 <br /> <br />Obviously the assessments would be made in the fall of the <br />year after the work is done, with the interest rate to be <br />determined at that time. <br /> <br />MAYOR DEMOS: Any written statements? <br /> <br />MR. ANDRE: We have two letters regarding this project, <br />one on behalf of Murphy Motor Freight concurring that the <br />improvements are necessary but objecting to the method of <br />assessments; and we have a letter from Burlington Northern <br />protesting the hearing on the basis that no benefit will inure. <br /> <br />MAYOR DEMOS: I will open the hearing to the public and <br />ask that each person come to the microphone and give his or her <br />name and the street address of the property to which they're <br />referring. <br /> <br />MR. CLIFFORD LUND, 2241 North Milton. I represent Roberts <br />Properties. We have four buildings on the south side of <br />Terminal Road (inaudible). Terminal Road really isn't in as bad <br />shape as Long Lake. (inaudible) We feel it should be delayed <br />until (inaudible) east or south which may be two to five years <br />down the road. We feel the improvement is necessary and that <br />an overlay would be sufficient on that portion of the road. <br /> <br />MR. JERRY HESS, Murphy Motor Freight Lines: I have just <br />given Jim another letter, though it's hand written. We had a <br />real estate appraiser here with us about the first three hours <br />of this marathon. The letter, I believe,would indicate that <br />while he's not averse to the improvement of the road, he does <br />not think the market value of Murphy's property would be enhanced <br />or improved by the road improvement. I think that's essentially <br />what he said. <br /> <br />On behalf of Murphy Motor Freight, we were one of the first <br />down in that area and we may have been some of the people putting <br />. pressure on to get that road. We have felt we were good neighbors <br />in Roseville and the laws say you have to have a benefit to the <br />property before you assess it. We don't feel there will be a <br />benefit to our property. We have the opinions of two real estate <br />experts in that regard. They are familiar with the area and <br />the Murphy property and have specified in correspondence to the <br />Council that the market value to the property will not be increased <br />by the improvement. The market value is the standard test in <br />determining whether the property has derived a real benefit. <br /> <br />The management at Murphy, despite this feeling, is not <br />adverse to the road improvement or adverse to paying a pro- <br />portionately larger share than the average person in Roseville <br />should pay, but the road is not there for our sole use. <br /> <br />The traffic studies you have done have been looked at by us. <br />We have done cursory traffic studies of our own which shows <br />(inaudible). We're being asked to accept 30% of the assessments <br />for that road. <br />
