<br />6 <br /> <br />than what the benefit is to the property itself, so if the lot <br />is worth $10,000 and you just take the full cost of the improve- <br />ment and it rises $10,000, if you can't sell it for $20,000 - <br />and that's done by expert testimony at a Court trial,- then the <br />Court will order it to be reduced to the amount the benefits are. <br />Many times we have seen the assessment set aside and sent back <br />to the Council to make that decision. The legislature last session <br />did change the law on assessments in that the decision on <br />assessments comes at an assessment hearing and the person must <br />send you, in writing, before or at the day of the hearing notice <br />of their intention to appeal. If they come in later and just <br />assess that's jurisdictional (inaudible) their assessment appeal <br />is thrown out. It's a burden on the property owner. <br /> <br />MAYOR DEMOS: Any written statements? <br /> <br />MR. ANDRE: There are no statements, but it's a 37% petition <br />so it requires three votes. <br /> <br />MAYOR DEMOS: I will open the hearing and ask that each <br />speaker come to the microphone and give his or her name and the <br />street address of the property to which they're referring. <br /> <br />MISS MILLIE KOLDO (?), 710 Lovell: I think you probably haven't <br />run into this before. Our street isn't broken up very bad and I <br />think (inaudible) I'll be assessed about $800. If you decide to put <br />it in next summer it would tear up 10, 15 feet of sod that I <br />just laid this fall and I just don't think it's necessary until <br />later. If later, then I wouldn't be assessed 100%. <br /> <br />MAYOR DEMOS: Is this on the north half? <br /> <br />MISS KOLDO: We don't have any trees yet. <br /> <br />MAYOR DEMOS: Is this going to be a similar situation to Oxford? <br /> <br />MR. HONCHELL: If you want to take a long view of history, <br />this is exactly how Oxford happened, only 25 years ago instead of <br />~oye~s a~. <br /> <br />MR. JUD BERTHIUI1E, 726 Lovell: I think that this is premature <br />also. This 100% assessment would be really difficult for me at <br />this time as far as monthly payments - any type of increase of this <br />nature - and I think that I could support it probably at 25%, but <br />not 100%. Another item that I'd like to bring up is that this is <br />a through street and I was wondering if there's any thought that <br />parking would stay on one side of the street because I think with <br />the traffic - looking at County Road B-2 and a long line-up of <br />cars there at night - we would probably get additional traffic on the <br />street if it was straightened out and widened, and with parking on <br />both sides I think it would maJce a difficult situation. <br /> <br />MAYOR DEMOS: Did the developer or realtor say anything about the <br />street when you bought it? <br />
