6 than what the benefit is to the property itself, so if the lot is worth $10,000 and you just take the full cost of the improve- ment and it rises $10,000, if you can't sell it for $20,000 - and that's done by expert testimony at a Court trial,- then the Court will order it to be reduced to the amount the benefits are. Many times we have seen the assessment set aside and sent back to the Council to make that decision. The legislature last session did change the law on assessments in that the decision on assessments comes at an assessment hearing and the person must send you, in writing, before or at the day of the hearing notice of their intention to appeal. If they come in later and just assess that's jurisdictional (inaudible) their assessment appeal is thrown out. It's a burden on the property owner. MAYOR DEMOS: Any written statements? MR. ANDRE: There are no statements, but it's a 37% petition so it requires three votes. MAYOR DEMOS: I will open the hearing and ask that each speaker come to the microphone and give his or her name and the street address of the property to which they're referring. This 100% assessment would be really difficult for me at this time as far as monthly payments - any type of increase of this nature - and I think that I could support it probably at 25%, but not 100%. Another item that I'd like to bring up is that this is a through street and I was wondering if there's any thought that parking would stay on one side of the street because I think with the traffic - looking at County Road B-2 and a long line-up of cars there at night - we would probably get additional traffic on the street if it was straightened out and widened, and with parking on both sides I think it would maJce a difficult situation. MAYOR DEMOS: Did the developer or realtor say anything about the street when you bought it?
