Such variation from the <br />height and area district regulation may be allowed for such building <br />by such governing body as they deem necessary. <br />(d) The frontage as laid out in the original platting of any <br />district shall be retained in the construction of buildings and <br />shall not be reversed. <br />(e) No change shall be made in the boundary line of the districts <br />or in the use, height, or area regulation of any district except after <br />a public hearing and upon the two-thirds vote of the council. The <br />council may, or upon a tion of fifty per cent by number of the <br />property owners within 0 Peet of the property to be affected by <br />the proposed change sha , fix a date which shall not be less than <br />ten days or more than thirty days away for a hearing upon the subject <br />of such change. Notice of such meeting and proposed change shall be <br />posted in at least three conspicuous public places in the member unit. <br />At the time and place filed in the pu3~lished notice the council shall <br />hear all objections and recommendations relative to such amendment, <br />supplement, change or repeal of the existing provision. <br />(f) It shall be the duty of the council to see that the provisions <br />of this plan are enforced through the proper legal channels, but they <br />may delegate the duty of administering it to any employee as they may <br />deem proper. 1~ny person objecting to the ruling of any official on <br />the administering of the provisions of this law shall have the right <br />to appeal to the council at any regular meeting. <br />(g) The owner of a building or premises in or upon which a viola- <br />tion of any provision of these regulations has been committed or shall <br />exist; or the lessee of entire building or entire premises in or upon <br />'which violation has been committed or shall exist; or the owner, lessee <br />of any part of the building or premise in or upon which such violation <br />has been committed or shall exist, shall be guilty of a mie8emeanor, <br />punishable by a fine oP not more than One Hundred Dollare(~100,00) for <br />each and every day that such violation continues. Any such person, <br />who having been served with an order to remove any such violation, <br />shall fail to comply with said order within ten days after such ser- <br />vice, or shall continue to violate any provision of the regulations <br />made under authority of this plan in the respect named in such order, <br />shall also be subject to a civil penalty of not to exceed One Hundred <br />Dollars 0100.00). <br />(h) In interpreting and applying the provisions of this plan, <br />they shall be held to be the minimum requirements for .the promotion <br />of the public safety, health, convenience, comfort, prosperity and <br />general welfare. It is not the intention of this plan to interfere <br />with or abrogate or annul any easements, covenants, or other agree- <br />ment between parties; provided, however, that where this ordinance <br />imposes a greater restriction upon the use of building or premises <br />or upon height of building, or requires larger open spaces than are <br />imposed or required by other ordinances, rules regulations, or permits, <br />or by easements, covenants or agreements, the provisions of this plan <br />shall govern. <br />
