The Village Council of Roseville do ordain as follows: SEOTIOlf 1 DEFIBITION OF TERMS As used in thi s ordinance, the terms (a) (b) (c) ( d.) (ij) (f) "Intoxicating liquor" and "liquor" mean distilled, vinous and fermented. .everages containing more than 3.2 per cent of alcohol by weight. "!eer" means any malt beverage with an alcoholic content of more than one-half of one per cent by volume and. not more than 3.2 per cent by weight. "On-sale" means sale by the drink for consumption in the dispensary. "Off-sale" means retail sale in the original package for consumption away from the dispensary. "Sell" includes all barters, gifts and other means of furnis~ing intoxicating liquor or beer in violation or evasion of this ordinance. "Minor" means any person under 21 years of age. SECTION 2 DISPD'SARY ESTABLISHED There is hereby established. a municipal liquor dispensary for the on and. off-sale of intoxicating liquor. No liquor may be sold at retail elsewhere in the village or by anyone not employed. in the dispensary except in such clubs as may be lawtully authorized. by the council. No person shall conSQme liquor in a public park, on a public street, or in any public place other than the municipal on-sale dispensary. SECTION 3 LOOATION .AND OPERATION (a) The d.ispensary shall be located at such suitable place or places in the village as the council determines by motion. However, no premises upon which taxes or other public levies are delinquent shall be leased for dispensary purposes. (b) The dispensary shall be in the immed.iate charge of the Village Olerk. He shall furnish a surety bond to the municipality, conditioned upon the faithful diSCharge of his duties, in such sum as the council specifies. The bond. premium shall be paid by the Village. The Village Clerk shall operate the dispensary under the council's direction and shall perform such duties in connection wi th the d.ispensary as may be imposed upon him by the council. He shall be responsible to the council for the conduct of the dispensary in full compliance with this ordinance and with the laws relating to the sale of liquor and. beer. (c) The council shall also appoint such additional employees as may be required for the dispensary and shall fix their compensation. All employees, including the manager, shall hold their positions at the pleasure of the council. No minor shall be employed in the dispensary. ..
