<br />~~.. <br /> <br />044 <br /> <br />CRDINANDE NO. 114 <br />.m ORDIliA.NCE EST.A:BLISHING A MUNICIPAL LIQ,UOR DISPENSARY. <br /> <br />The Village Council of Roseville do ordain as follows: <br /> <br />SEOTIOlf 1 <br />DEFIBITION OF TERMS <br /> <br />As used in thi s ordinance, the terms <br /> <br />(a) <br />(b) <br />(c) <br />( d.) <br />(ij) <br />(f) <br /> <br />"Intoxicating liquor" and "liquor" mean distilled, vinous and fermented. <br />.everages containing more than 3.2 per cent of alcohol by weight. <br />"!eer" means any malt beverage with an alcoholic content of more than one-half <br />of one per cent by volume and. not more than 3.2 per cent by weight. <br />"On-sale" means sale by the drink for consumption in the dispensary. <br />"Off-sale" means retail sale in the original package for consumption away from <br />the dispensary. <br />"Sell" includes all barters, gifts and other means of furnis~ing intoxicating <br />liquor or beer in violation or evasion of this ordinance. <br />"Minor" means any person under 21 years of age. <br /> <br />SECTION 2 <br /> <br />DISPD'SARY ESTABLISHED <br /> <br />There is hereby established. a municipal liquor dispensary for the on and. off-sale <br />of intoxicating liquor. No liquor may be sold at retail elsewhere in the village or by <br />anyone not employed. in the dispensary except in such clubs as may be lawtully authorized. <br />by the council. No person shall conSQme liquor in a public park, on a public street, <br />or in any public place other than the municipal on-sale dispensary. <br /> <br />SECTION 3 <br />LOOATION .AND OPERATION <br /> <br />(a) The d.ispensary shall be located at such suitable place or places in the village <br />as the council determines by motion. However, no premises upon which taxes or other <br />public levies are delinquent shall be leased for dispensary purposes. <br /> <br />(b) The dispensary shall be in the immed.iate charge of the Village Olerk. He shall <br />furnish a surety bond to the municipality, conditioned upon the faithful diSCharge of <br />his duties, in such sum as the council specifies. The bond. premium shall be paid by the <br />Village. <br /> <br />The Village Clerk shall operate the dispensary under the council's direction <br />and shall perform such duties in connection wi th the d.ispensary as may be imposed <br />upon him by the council. He shall be responsible to the council for the conduct of <br />the dispensary in full compliance with this ordinance and with the laws relating to <br />the sale of liquor and. beer. <br /> <br />(c) The council shall also appoint such additional employees as may be required <br />for the dispensary and shall fix their compensation. All employees, including the <br />manager, shall hold their positions at the pleasure of the council. No minor shall be <br />employed in the dispensary. <br /> <br />.. <br />
