lOr '. 1 or premise in or upon which such violation has been committed or shall exist, shall be guilty of a misdemeanor, punishable by a fine of not more than One Hundred Dollars ($100.00) for each and every clay that such violation continues. Any such person, who having been served with an' order to remove any such violation, shall fail to comply with said order within ten nays after such service, or shall continue to violate any provision of the regulations made under authority of this plan in the respect named in such order, shall also be subject to a civil penalty of not to exceed One Hundred Dollars ($100.00). (h) In interpreting and applying the provisions of this plan, they shall' be held to be the minimttm requirements for the promotion of the public safety, health, convenience, comfort, prosperity and general welfare. It is not the intention of this plan to interfere with or abrogate or annul any easements, covenants, or other agreement between parties; provided, however, that where this ordinance imposes a greater restriction upon the use of building or premises or upon height of building, or requires larger open spaces than are imposed or required by other ordinances, rules, regulations, or permits, or by easements, covenants or agreements, the provisions of this plan shall govern. (i) If any section, sub-section, sentence, clause or phrase of this plan is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this plan. SECTION 13 Ordinance No. 105 entitled "An Ordinance for the Purpose ofl?roIloting the Public Health, Safety, Order, Commerce, Property and General Welfare by Providing for the Classification, Regulation and Restriction of the Erection of Trades and Industries and of Buildinis Used for Human Habitation and for Specified Purposes, Regulating and Determining the ltinimuIl Size of Yard Areas, Establishing the Breakdown of Districts for Said Purposes, and Providing Penalties for Violation Thereof" as amended, is hereby repea1~d. SECTION lh This ordinance shall be in force and effect from and after its adoption. SECTION 15 Any person violating any of the provisions of this ordinance shall be guilty of a misdemeanor punishable by a fine not to exceed $100.00 or by imprisonment not exceeding 90 day..
