<br />lOr <br />'. 1 <br /> <br />or premise in or upon which such violation has been committed or shall exist, <br />shall be guilty of a misdemeanor, punishable by a fine of not more than One <br />Hundred Dollars ($100.00) for each and every clay that such violation continues. <br />Any such person, who having been served with an' order to remove any such violation, <br />shall fail to comply with said order within ten nays after such service, or shall <br />continue to violate any provision of the regulations made under authority of this <br />plan in the respect named in such order, shall also be subject to a civil penalty <br />of not to exceed One Hundred Dollars ($100.00). <br /> <br />(h) In interpreting and applying the provisions of this plan, they shall' <br />be held to be the minimttm requirements for the promotion of the public safety, <br />health, convenience, comfort, prosperity and general welfare. It is not the <br />intention of this plan to interfere with or abrogate or annul any easements, <br />covenants, or other agreement between parties; provided, however, that where <br />this ordinance imposes a greater restriction upon the use of building or premises <br />or upon height of building, or requires larger open spaces than are imposed or <br />required by other ordinances, rules, regulations, or permits, or by easements, <br />covenants or agreements, the provisions of this plan shall govern. <br /> <br />(i) If any section, sub-section, sentence, clause or phrase of this plan <br />is for any reason held to be unconstitutional, such decision shall not affect <br />the validity of the remaining portions of this plan. <br /> <br />SECTION 13 <br /> <br />Ordinance No. 105 entitled "An Ordinance for the Purpose ofl?roIloting the <br />Public Health, Safety, Order, Commerce, Property and General Welfare by Providing <br />for the Classification, Regulation and Restriction of the Erection of Trades <br />and Industries and of Buildinis Used for Human Habitation and for Specified <br />Purposes, Regulating and Determining the ltinimuIl Size of Yard Areas, Establishing <br />the Breakdown of Districts for Said Purposes, and Providing Penalties for <br />Violation Thereof" as amended, is hereby repea1~d. <br /> <br />SECTION lh <br /> <br />This ordinance shall be in force and effect from and after its adoption. <br /> <br />SECTION 15 <br /> <br />Any person violating any of the provisions of this ordinance shall be <br />guilty of a misdemeanor punishable by a fine not to exceed $100.00 or by <br />imprisonment not exceeding 90 day.. <br /> <br />Passed by the Council this 17th day of February, 1953. <br /> <br />Approved: <br /> <br />Mayor <br /> <br />(SEAL) <br /> <br />Attest: <br /> <br />
