<br />105 <br /> <br />area of land than that occupied by such use at the time of the adoption of this <br />plan; nor shall any such non-conforming use be moved to any other part of the <br />parcel of land upon which the SaIle was conduct.ed, at the time of the adoption <br />of this plan. A non-conforming use of a building/existing at the time of the <br />adoption of this plan may be extended throughout the building, provided no <br />structural alterations except those required by ordinance, law, or other <br />regulations are made therein. If such non-conforming use consists of a sub- <br />stantial building and ceases for a continuous period of two years, any sub- <br />sequent use of said building shall be in conformity to the regulations <br />flpecified by this plan for the district in which such building is located; <br />however, if any non-conforming use of land on which there are no substantial <br />buildings ceases for any reasonable length of time, any subsequent use of such <br />land shall be in conformity to regulations specified by this plan for the <br />district in which such land is located. <br /> <br />(b) Any building which does not conform'to the use and height district in <br />which it is located shall not be rebuilt or reconstructed to its former use and <br />physical dimensions if damaged 50% or more by fire, wind, earthquake or explosion <br />according to the estimate of the Building Inspector ffild accepted by the Council. <br /> <br />(c) Public utility buildings to be used for purposes of rendering servic~ <br />to the community and not for ware house purposes, or for the storage of bulky <br />materials, when the governing body of the member unit in which located shall <br />deem them to be clearly necessary for the public convenience may be permitted in <br />any district. Such variation from the height &ld area distr~ct regulation may be <br />allowed for such building by such governing body as they deem necessary. <br /> <br />(d) The frontage as laid out in the original platting of any district shall <br />be retained in the construction of buildings and shall not he reversed. <br /> <br />( e) No change shall be 1tade in the boundaI'l line of the districts or in <br />the use, height, or area regulation of any district except after a public hearing <br />and upon the two-thirds vote of the council. The council may, or upon a petition <br />of fifty percent of the property owners by number within 250 feet of the property <br />to be affected by the proposed change shall, fix a date which shall not be less <br />than ten days or more than forty days awa~r for a hearing upon the subject of <br />such change. Notice of such meeting and prorosed change shall be posted in at <br />least three conspicuous public places in the village. At the time and place <br />fixed in the published notice the council shall hear all objections and re- <br />cOlll.l4endations ~relative to such amendment, supplement, change or repeal of the <br />existing provision. <br /> <br />(ee) Upon application to~ the Council, the Council by four-fifths (4/5ths) <br />vote may grant, in undeveloped sections of the Village, temporary and conditional <br />permits for a period of time as warranted; however, not to exceed ten (10) years <br />for structures and uses in contravention to the requirements of this ordinance. <br /> <br />(f) It shall be the duty of the Council to see that the provisions of <br />this plan are enforced through the proper legal channels, but the~' 11ay delegate <br />the duty of 'administering it to any employee as they may deem proper. Any <br />person objecting to the ruling of &lY official on the administering of the provisions <br />of this law shall have the right to appeal to the council at any regular meeting. <br />a <br />(g) The owner of a building or premises in or upon which/violation of <br />any provision of these regulations has been co~~itted or shall exist; or the <br />lessee of entire building or entire premises in or upon which violation has <br /> <br />been committed or shall exist; or the owner, lessee of any part of the building <br />
