<br />114 <br /> <br />Whereas, the Council has called and held a hearing upon the matter of <br />amending the set back Md. side yard provisions of the zoning ordinance for said <br />- above described propert..y. <br /> <br />SECTION 1 <br /> <br />That Ordinance No. 1.49 enUtled "An Ordinance for the Purpose of Pro- <br />moting the Public Health, Safety, Order, Commerce, Property and General Welfare <br />by Providing for the Classification, Regulation and Restricti~n of the Erection <br />of Trades and Industries and of Buildings used for Human Habitation and for Spec- <br />ified Purposes, Regulating and Determining the Minimum Size of Yard Areae, Estab- <br />lishing the Breakdown of Districts for Said Purposes, and Providing Penalties <br />for Violation Thereof", be amended by amending the zoning map so that said <br />property above dftscribed be classified and zoned as a busines8 district. <br /> <br />. SECTiON 2 <br /> <br />That said zoning ordinance and zoning map be further amended so that <br />the following set backs be required for said above- described property: 130 feet. <br />along the West< side of lfestmoor Addition and extending 160 feet North of i;he <br />North line thereof; 160 feet along the North side of Westmoor- Addition, -y, feet <br />along the South line of Lot 7, Leinen Heights, 75 feet along the North line of <br />Lot 6, Leinen Heights, 75 feet along the South line of Bolstad's Addition, 60 <br />feet along the West side of Bolstad'S Addition, extending 75 feet South of the <br />South line thereof. In addition to said set backs along the South and West of <br />Bolstad IS Addition, there shall:- be an additional set back of 125 feet which may <br />. be used for any permissible business purposes except the construction of build- <br />ings therein. <br /> <br />SECTION 3 <br /> <br />The set back areas, except those upon which business use is permitted <br />as described in Section 2. hereof, s~l be limited to the use of seeding grass, <br />planting shrubbery and trees and maintaining same, and as soon as practicable, <br />there shall be planted two rows of trees, one row of which shall be some type of <br />pine tree, within said set back areas adjacent to Bolstad's Addition. <br /> <br />SECTION 4 <br /> <br />This ordinance shall take effect and be in force from and after its passage <br />and puba..ication and upon the filing with the Clerk wi thin 30 days thereafter by <br />the petitioner of its written acceptance of the provisions hereof. <br /> <br />~ <br />Passed by the Council this 21st day of April, 1953. <br /> <br />George S.
