<br />13 ~R;INANCE NO. 162 <br /> <br />AN ORDINANCE RELATING TO THE OPERATION OF MOTOR BOATS IN THE PUBLIC WATERS <br />IN THE VILLAGE OF ROSEVILLE. <br /> <br />The Village Council of R08evil~ ordains: <br /> <br />SECTION 1 <br /> <br />The words, "motor boat" as used in this ordinance includes ever,y vessel <br />propelled by machinery. <br /> <br />SECTION 2 <br /> <br />Subdivision 1. No motor boat shall be operated on any public waters in <br />the Village of Roseville at a speed greater than is reasonable and proper <br />having due regard to the safety of other boats and persons. <br /> <br />Subdivision 2. Whenever any motor boat passes within three hundred feet <br />(300) of any shoreline upon which any person is fishing or swimming, or ap- <br />proaches withj~ three hundred (300) feet of any other boat, unless such other <br />boat is unoccupied, said motor boat ~hall be operated at its slowest speed, and <br />the operator of said motor boat shall take adequate precautions to throttle <br />down his speed prior to approaching within said distance to the end that the <br />speed shall be appropriately reduced within the indicated distance. <br /> <br />Subdivision 3. Whenever any motor boat passes within three hundred (300) <br />feet of any other occupied boat at a speed such that the backwash or waves <br />created by said motor boat are sufficiently large to upset, capsize, or over- <br />turn such other boat, the presence of such waves or backwash shall be deemed <br />prima facie evidence of violation of this ordinance. <br /> <br />SECTION 3 <br /> <br />No motor boat shall be used for the purpose of water skiing or surf- <br />boarding on any lake unless such operation is performed in a manner so that <br />neither the boat nor the skiier or surfboard rider comes within three hundred <br />feet (300) of shoreline, docks, swimmers or other boats while such skiier or <br />surfboard rider is skimming the surface of the water. <br /> <br />SECTION 4 <br /> <br />Subdivision 1. No motor boats shall engage in any form of race, game of <br />tag, game of follow-the-leader or any other stunting or exhibition except in <br />the case of a properly sponsored boat race or water show or exhibition. <br /> <br />Subdivision 2. No person, firm organization or corporation shall <br />sponsor, conduct or operate a motor boat race, show or exhibition on any <br />public waters within the Village without first obtaining a permit from the <br />Village Council. <br /> <br />SECTION 5 <br /> <br />For the purpose of regulating the operation of motor boa.ts on the public <br />waters within the Village the provisions of Minnesota Statutes Annotat.ed <br />(M.S.A.), Sections 361.22 to 361.26, inclusive, are adopted and by this re- <br />ference made a part of this ordinance as completely as if set forth in full <br />herein. <br />
