<br />ORDINANCE GRANTING \-lATER 1rlaRKS FRANCHISE
<br />ORDINANCE NO. 296
<br />
<br />BE IT ORDAINED by the Village Council of the Villao:e of Roseville, in the
<br />County of Ramsey and State of Ninnesota:
<br />
<br />An Ordinance granting Minnesota W~.ter Company, Inc. a Minnesota Corporation,
<br />its successors and assigns, the power and privilege to lay, repair, own, operate,
<br />manage, and maintain pipes, conduits and materials necessary for distribution of
<br />water through pipes, conduits and materials in, along, and upon and over certain
<br />streets, alleys and public places of the Village of Roseville, Minnesota, for
<br />the general, domestic, commercial and other purposes in that portion of the
<br />Village in Sectionl and Section 12, Township 29, Range 23 laying northerly of
<br />the north right-of-way Une of state Trunk Highway No. 36 as it now exists.

<br />SECTION 1. That the Minnesota Water Company, Inc., a Minnesota Corporation,
<br />hereinafter referred to as the Water Company, its successors and assigns, are
<br />authorized, empowered and franchised to use the streets, alleys and public places
<br />of said Village to lay and maintain pipes, conduits, mains and materials for the
<br />conveyance of water in that portion of the Village in Section 1 and Section 12,
<br />Township 29, Range 23 lying northerly of the north right-of-way line of State
<br />Trunk Highway No. 36 as it now exists.
<br />
<br />SECTION 2. That said l,rater Company shall h~re the exclusive privilege of
<br />laying' down pipes for comreying of .....rater in that portion of the Village in Section
<br />1 and Section 12, Township 29, Range 23 lying northerly of the north right-of-way
<br />line of State Trunk Highway No. 36 as it now exists, and as otherwise au thorized
<br />and directed by said \Tillage Council in said Village for the use of said Village
<br />and its inhabitants, PROVIDED that said Water Company shall commence the
<br />construction of said r,.rater works wi thin ninety (90) days of the approval and the
<br />passage and publication of said Ordinance., and PROVIDED that said TATater Company
<br />shall keep and maintain such system of water works with all fU~lre additions and
<br />extensions in successful operation thereafter during the term of franchise;
<br />accidents or delays consistent with ordinary precaution only exoepted.

<br />SECTION 3. Before laying any pipes, conduits or materials of said water works
<br />system the Water Company shall furnish to the Village Council nlans, specifications
<br />and profiles showing the construction and location of the pipes along the streets
<br />and public places over which the Water Company may from ti'1'le to time occuPy, and
<br />the same shall be subject to approval by the Village Council before any work
<br />shall be done thereon.

<br />SECTIOl\! 4. The Pipes, conduits, and materials of said irlater works system
<br />shallbe laid or constructed, maintained, operated and repaired with the least
<br />practicable in,jury or delay to the public, a.nd said itJater Company shall, as soon
<br />as practicable, after the vprk is done, replace the streets, sidewalks, alleys
<br />and public grounds and public improvements at its own expense in as good condition
<br />as they were before the work was commenced.

<br />SSCTION 5. That said Water Compa.ny shall so lay the pipes, conduits and
<br />materials in such maQ~er as not to interfere unduly with travel on said streets,
<br />Sidewalks, alleys or public grounds, and public improvement, and shall repair and
<br />restore to a.s good condition as they were before the work was commenced all those
<br />parts of tbe same interfered with or used in layinn:, by the compa.ny, said pipes,
<br />conduits, and materials.
