<br />either (1) cash, or (2) an indemnity bond, with sureties <br />satisfactory to the Village, conditioned upon the payment of all <br />construction costs incurred by the Village in the making of such <br />improvements, and all expense incurred by the Village for engineering <br />and legal fees and other incidental expense in connection with the <br />making of such improvement. Such bond shall also be conditioned <br />upon the payment of all costs of the street grading and, if elected <br />to be done by the owner or subdivider, the laying of the sub-base, <br />to the same extent as a bond furnished pursuant to Minnesota <br />Statutes Section 574.26. <br />All such improvements shall be made in accordance with <br />the plans and specifications prepared by, and under the supervision <br />of, the Village Engineer, and in accordance with applicable <br />requirements. Subject to such conditions, the owner or subdivider <br />shall do or contract for the necessary grading. He may also, at <br />his election, do or contract for the laying of the required sub- <br />base. All other improvements shall be done by the Village, either <br />under construction contracts, pursuant to competitive bidding, or, <br />where lawful, in the discretion of the Village, by day labor, <br />except that the Village may authorize the owner or subdivider to <br />construct any other required improvement. In the event of a cash <br />deposit, any balance remaining shall be refunded to the owner and <br />subdivider after payment of all costs and expenses of the Village <br />and the submission of appropriate evidence that all cost of grading <br />and/or laying of sub-base have been paid.
