<br />ARTICLE V. <br /> <br />CONSTRUCTION, INITIAL SERVICE AREA <br />LINE EXTENSION AND CONSTRUCTION STANDARDS <br /> <br />SECTION 1. INITIAL SERVICE AREA <br /> <br />( <br /> <br />Grantee shall construct as the initial service area all areas containing <br /> <br />dwelling units within City, so that every dwelling unit within City constructed, in <br /> <br />the sole opinion of City, prior to the completion of construction of System in the <br /> <br />initial service area, shall be able to receive service from the System at the same <br /> <br />rates and charges which are set forth in Exhibit A of this Franchise. Crantee <br /> <br />shall extend service to any area within the corporate boundaries of the City <br /> <br />which was not constructed as part of the initial service area, which subsequently <br /> <br />exceeds a density of 35 dwelling units per street mile or greater, at the same <br /> <br />rates and charges which are set forth in Exhibit A of this Franchise. Trunk lines <br /> <br />will be extended to all City boundaries as such trunklines are designated in the <br /> <br />maps provided in the Offering. <br /> <br />SECTION 2. LINE EXTENSION POLICY <br /> <br />Grantee's extension of service to those areas not constructed as part of the <br /> <br />initial service area shall comply with the following requirements: <br /> <br />A. <br /> <br />In the portions of the line extension area which do not exceed <br />35 dwelling units per street. mile, Grantee shall provide cable <br />television on a cost-sharing arrangement. If any potential <br />subscriber requests that the line be extended, Grantee shall <br />calculate the cost on a time and material basis. Grantee shall <br />bear the cost of the first $400 per dwelling unit passed by the <br />line extension. All subscribers served by any such extension will <br />bear in equal shares the remainder of all costs. If additional <br />subscribers receive service from the line extension, they will <br />assume their pro-rated share in the line extension cost; and, <br />appropriate rebates will be made to subscribers having <br />previously assumed those costs or if said subscriber cannot be <br />located by Grantee, appropriate rebates will be made to the <br />current subscriber of affected dwelling unit.
