<br />line extension density remains at or under 35 dwelling <br />units per street mile contiguous to the initial service area,- <br />Grantee shall rebate to subscribers on the line extension <br />on a pro-rated basis $400 for each additional dwelling unit <br />built. In no event will a subscriber who partially assumed <br />construction costs be rebated more than the amount <br />initially assumed by that subscriber. <br /> <br />( <br /> <br />B. <br /> <br />If the line extension has been built and exceeds a density <br />of 35 dwelling units per street mile contiguous to the <br />initial service area, Grantee shall rebate all monies paid <br />by those subscribers who have assumed line extension <br />costs. In no event will a subscriber who partially assumed <br />construction costs be rebated more than the amount <br />initially assumed by the subscriber. <br /> <br />c. For installation of service drops longer than 200 feet, the <br />resident shall be charged an additional amount for the <br />installation equal to the incremental increase of the cost <br />of time and materials for everything longer than 200 feet. <br /> <br />SECTION 3. CONSTRUCTION TIMETABLE <br /> <br />A. Within 90 days after the effective date of the Board <br />Certification of Franchise, Grantee shall apply for all necessary <br />permits, licenses, certificates, and authorizations which are <br />required in the conduct of its business, including, but not <br />limited to, any joint use attachment agreements, microwave <br />carrier licenses, or any other permits, licenses, and <br />authorizations to be granted by duly constituted regulatory <br />agencies having jurisdiction over the operation of cable <br />communication systems, or their associated microwave <br />transmission facilities. If after one year from the <br />commencement of Franchise term, Grantee has not received <br />the permits, licenses, certificates, and authorizations described <br />in this paragraph, City may terminate this Franchise without <br />regard to fault for delay in obtaining such permits, licenses, <br />certificates, and authorizations. <br /> <br />B. <br /> <br />Within 90 days of obtaining all necessary permits, licenses, <br />certificates, and authorizations, Grantee shall give written <br />notice thereof to City and commence construction and <br />installation of System. Grantee shall construct all areas of the <br />initial service area which contain dwelling units within eighteen <br />months of the granting of the state certificate of confirmation <br />so that persons along the route of the energized cable will have <br />individual "drops" as desired during the same period of time. <br /> <br />( <br /> <br />c. Any delays in the construction timetable or commencement of <br />construction shall result in penalties as provided in this <br /> <br />- 24 - <br />
