<br />subsequent request for a rate increase <br />pursuant to this Franchise or any franchise- <br />granted to Grantee relative to the cable <br />communications system delineated in the <br />Offering. <br /> <br />( <br /> <br />(h) A fair rate of return with respect to <br />investments having similar risks to that of <br />providing cable communication services; <br /> <br />(i) The extent to which Grantee has adhered to <br />the terms of the Franchise; <br /> <br />(j) Fairness to residents and subscribers; <br /> <br />(k) Capital expenditures (actual and, if the <br />situation so warrants, projected) by Grantee in <br />providing updated technology and service to <br />subscribers; <br /> <br />(I) The extent to which Grantee has then provided <br />service to schools, hospitals, libraries, publicly <br />owned or leased buildings, and similar <br />institutions within the City; <br /> <br />(m) The extent to which Grantee has <br />technologically upgraded the System; <br /> <br />(n) Increased or decreased expenses incurred by <br />Grantee in the purchase of services; and <br /> <br />(0) Such other factors as City or Grantee may <br />deem relevant. <br /> <br />(3) The procedures to be followed in changing a Basic <br />Service rate or charge shall include at least the <br />following: <br /> <br />(a) Grantee shall give City written notice of any <br />requested Basic Service rate increase. <br /> <br />l <br /> <br />(b) The application shall be supported by <br />statistical and other proof indicating that the <br />existing rate or charge is inadequate and <br />unreasonable and that the proposed increases <br />are required to enable Grantee to render <br />service to fulfill its obligations under this <br />Franchise and to derive a reasonable profit <br />therefrom. <br /> <br />(c) The notice shall include current financial and <br />other information with at least the following: <br /> <br />1.
