<br />the term of this Franchise or as required by federal <br />or state law. In addition to these discretionary- <br />evaluation sessions, regular evaluation sessions shall <br />be conducted by City within 30 days of the third, <br />fifth and eighth anniversary dates of the date of <br />acceptance of this Franchise by Grantee. <br /> <br />( <br /> <br />(3) All evaluation sessions shall be open to the public <br />and notice of sessions published in the same way as a <br />legal notice. Grantee shall notify its subscribers of <br />all evaluation sessions by announcement on at least <br />two channels of the system between the hours of <br />7:00 p.m. and 9:00 p.m. for five consecutive days <br />preceding each session. <br /> <br />(4) Topics which may be discussed at any evaluation <br />session may include, but not be limited to, service <br />rate structures; franchise fee; penalties; free or <br />discounted services; application of new technologies; <br />system performance; services provided; <br />programming offered; community access; local <br />origination; customer complaints; privacy; <br />amendments to this Franchise; judiCial, Board and <br />FCC rulings; line extension policies, and Grantee or <br />City Rules. <br /> <br />(5) During a review and evaluation by City, Grantee <br />shall fully cooperate with City and shall provide <br />without cost such information and documents as <br />City may request to reasonably perform the <br />evaluation. <br /> <br />(6) If at any time during its review, City determines <br />that reasonable evidence exists of inadequate <br />System performance, it may require Grantee to <br />perform tests and analyses directed toward such <br />suspected inadequacies at the Grantee's own <br />expense. Grantee shall fully cooperate with City in <br />performing such testing and shall prepare results and <br />a report, if requested, within 30 days after notice. <br />The report prepared by Grantee shall include at <br />least: <br /> <br />l <br /> <br />(a) A description of the problem in System <br />performance which precipitated the special <br />tests. <br /> <br />(b) What System component was tested. <br /> <br />- 40 - <br />
