<br />The annual fee for an off-sale license is two hundred dollars ($200.00). <br /> <br />(2) The entire fee for club, special Sunday, and off-sale licenses and <br />$500.00 of the fee for "on-sale" intoxicating liquor licenses and for wine licenses <br />shall be paid before the application is accepted and the remaining balance, if <br />any, shall be paid before the license is issued. All fees shall be paid into the <br />general fund of the City. Upon rejection of any application for a license, or upon <br />withdrawal of the application before approval of the issuance by the City <br />Council, the license fee shall be refunded to the applicant except where the <br />rejection is for willful misstatement on the license application. <br /> <br />(3) The fee for "on-sale" and "on-sale wine" licenses granted after the <br />commencement of the license year shall be prorated on a monthly basis. <br /> <br />(4) At the time of each original application for a license, except special <br />club licenses, the applicant shall pay in full an investigation fee. The <br />investigation fee shall be three hundred dollars ($300.00). No investigation fee <br />shall be refunded. <br /> <br />151.050. Granting of Licenses. <br /> <br />(1) Investigation and Issuance. The City Council shall investigate all <br />facts set out in the application. Opportunity shall be given to any person to be <br />heard for or against the granting of the license. After the investigation and <br />hearing, the Council shall, in its discretion, grant or refuse the application. At <br />least ten days published notice of the hearing shall be given, setting forth the <br />name of the applicant and the address of the premises to be licensed. <br /> <br />(2) Person and Premises Licensed; Transfer. Each license shall be issued <br />only to the applicant and for the premises described in the application. No <br />license may be transferred to another person or place without City Council <br />approval. Before a transfer is approved, the transferee shall comply with the <br />requirements for a new application. Any transfer of 50 percent or more of the <br />stock of a corporate licensee is deemed a transfer of the license and a transfer <br />of stock without prior Council approval is a ground for revocation of the license. <br /> <br />151.060. Persons Ineligible for License. No license shall be granted to <br />any person made ineligible for such a license by state law. <br /> <br />151.070. Delinquent Taxes and Charges. No license shall be granted for <br />operation on any premises on which taxes, assessments, or other financial claims <br />of the City are delinquent and unpaid. <br /> <br />151.080. Conditions of License. Every license is subject to the condi- <br />tions in the following subdivisions and all other provisions of this ordinance and <br />any other applicable ordinance, state law or regulation. <br /> <br />(1) Licensee's Responsibility. Every licensee is responsible for the con- <br />duct of his place of business and the conditions of sobriety and order in it. The <br />act of any employee on the licensed premises authorized to sell intoxicating <br />liquor there is deemed the act of the licensee as well, and the licensee shall be <br />liable to all penalties provided by this ordinance and the law equally with the <br />employee. <br />
