<br />AGREEMENT <br /> <br />THIS AGREEMENT, made and entered into by and <br /> <br />between the VILLAGE OF ROSEVILLE, Minnesota, a municipal <br /> <br />corporation, hereinafter referred to as the VILLAGE; and S. L. WASIE <br /> <br />and E. L. MURPHY" JR. I hereinafter referred to as the OWNERS, <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the State of Minnesota had a flowage <br /> <br />easement across certain real property owned by the OWNERS lying <br /> <br />and being within Ram sey County I Minne sota I hereinafter referred <br /> <br />to; and <br /> <br />WHEREAS, on September 30, 1963, the State of Minnesota <br /> <br />and the VILLAGE entered into a cooperative agreement whereby the <br /> <br />VILLAGE was to be responsible for the drainage from the land therein; <br /> <br />and <br /> <br />WHEREAS, it is the intention of the VILLAGE to release <br /> <br /> <br />to some property owners the entire flowage easement in consideration <br /> <br /> <br />d the property owners paying to the VILLAGE sufficient sums of money <br /> <br />to enable the VILLAGE to construct a pumping station, <br /> <br /> <br />NOW, THEREFORE, IT IS HEREBY AGREED BY AND BETWEEN <br /> <br />THE ABOVE NAMED PARTIES AS FOLLOWS: <br /> <br /> <br />1 . The OWNERS agree to give to the VILLAGE <br /> <br /> <br />the sum of Five Thousand Ddlars ($5,000.00) in consideration of <br /> <br /> <br />the VILLAGE directing the State of Minnesota to give appropriate <br /> <br />documents conveying all of the right, title and interest in and to said <br />
