<br />are unwilling to negotiate with the Village on a reasonable <br />basis for the acquisition of the same; and <br /> <br />WHEREAS, the statutes of the State of Minnesota state <br />that the Village has the power and authority to take and <br />acquire said property by condemnation under the power of <br />eminent domain; <br /> <br />NOW,. THEREFORE,. BE IT RESOLVED BY the Village Council <br />for the Village of Roseville, Minnesota, as follows: <br /> <br />The Village Council hereby deems that it is necessary <br />and convenient that perpetual easements over the properties <br />described below be acquired by said Village by condemnation <br />being situated in the County of Ramsey and State of Minnesota, <br />to-wit: <br /> <br />Tract No. 1 CST 104) <br /> <br />The West 15 feet of the East 177.5 feet of Lot <br />Four (4), Block Two (2), T. M. Connor Plat, with <br />temporary construction easement lying 10 feet <br />on either side. <br /> <br />Tract No. 2 CST 110) <br /> <br />The East 7.5 feet of Lots Three (3) and Ten (10) <br />and the West 7.5 feet of Lots Two (2) and Eleven <br />(11) all in Block Two (2), Bowes Addition, with <br />temporary construction easement lying 10 feet on <br />either side. <br /> <br />That the estate to be acquired in the property des- <br />cribed above is a perpetual easement for constructing, main- <br />taining, operating, and repairing storm sewer mains, pipes <br />and appurtenances over and across said property, together <br />with ingress and egress. <br /> <br />That the Village Attorney be and he hereby is in- <br />structed to institute the necessary proceedings in condemnation <br />under the power of eminent domain in the name and in behalf <br />of the Village of Roseville, Minnesota, to acquire the <br />property hereinabove described under the statutes of the <br />State of Minnesota, and the said attorney is further in- <br />structed and directed to take such steps as may be necessary <br />to carry said proceedings to a conclusion. <br /> <br />-2- <br />
