<br />WHEREAS, on November 12, 1964, on December 2, 1964, on <br />December 21, 1964 and on January 18, 1965, negotiation meetings were held <br />between representatives of the above municipalities and the Technical <br />Committee of the City of Saint Paul; and <br /> <br />WHEREAS, at the conclusion of the above meetings, the above <br />Villages were assured that a draft of a new contract and new rates and <br />charges would be submitted to the above Villages by the City of Saint Paul; <br />and <br /> <br />WHEREAS, as of this date no new contract, including new rates <br />and charges has been submitted by the City of Saint Paul; and <br /> <br />WHEREAS, the Village Council of the Village of Roseville is <br />satisfied that negotiations will not be successful in arriving at a new contract <br />for sanitary sewage disposal; and <br /> <br />WHEREAS, the Village d Roseville intends to exercise its <br />remedies pursuant to M.S. A. ~1l5.49; and <br /> <br />WHEREAS, the Villages of Arden Hills, Shoreview and S1. Anthony <br />would benefit from any success that the Village of Roseville has in re-establishing <br />of new basis for rates and charges for sanitary sewage disposal, <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL <br />FOR THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLLOWS: <br /> <br />1. The Village Council of the Village of Roseville demands, <br />pursuant to M.S.A. ~1l5.49, a new basis for rates and charges for sanitary <br />sewage disposal through the facilities of the City of Saint Paul. The new <br />basis demanded by the Village of Roseville is a rate based on sanitary sewage <br />volume only, to be determined by actual cost to the City of Saint Paul for <br />the conveyance and treatment of sanitary sewage from the Village of Roseville. <br /> <br />2. The City Council of the City of Saint Paul is hereby <br />requested and demanded by the Village of Roseville, pursuant to M.S.A. ~1l5.49, <br />to hold a hearing for the determination of proper rates and charges. <br /> <br />3. The Village s of Arden Hills, Shoreview and 8t. Anthony <br />are hereby invited to participate in the proceedings instituted by the Village <br />of Roseville pursuant to M.S.A. ~1l5.49, as interested third parties. <br /> <br />4. The Village Manager of the Village of Roseville is hereby <br />instructed to certify copies of this Resolution and to serve the same upon the <br />City Clerk of the City of Saint Paul, the Village Clerk of the Village of St. <br />Anthony, the Village Clerk of the Village of Arden Hills and the Village Clerk <br />of the Village of Shoreview. <br /> <br />-.2- <br />
