<br />WHEREAS. the Village Council deems it necessary and <br />expedient to grant authority to the Village Attorney to commence <br />eminent domain proceedings against all owners of property with whom <br />the Village cannot negotiate easements, <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL <br />OF THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLWWS: <br /> <br />1) That the Village Council hereby deems that it is necessary <br />and convenient that perpetual easements be acquired by the Village by <br />condemnation over all property where it is necessary to obtain said <br />easements, in the event said easements cannot be obtained by direct <br />negotiations with the property owners. <br /> <br />2) That the estate to be acquired in the properties is a <br />perpetual easement for constructing, maintain~ng, operating and repairing <br />storm sewer mains, pipes and appurtenances over and across said <br />property, together with ingre s sand egre s s. <br /> <br />3) That the Village Attorney be and hereby is instructed to <br />institute the necessary proceedings in condemnation under the power of <br />eminent domain in the name and in behalf of the Village of Roseville, <br />Minnesota, to acquire perpetual easements across all properties where <br />easements cannot be acquired by direct negotiations with the parties, <br />and the said attorney is further instructed and directed to take all such <br />steps as may be necessary to carry said proceedings to a conclusion. <br /> <br />4) That the Village Attorney is hereby given authority to <br />determine when negotiations cannot be consummated and he is further <br />given authority as to the time in which condemnation proceedings should <br />be instituted thereafter. <br /> <br />The motion for the adoption of the foregoing resolution was <br />duly seconded by Member Grauel , and upon a vote being <br />taken, the following voted in favor of the resolution: <br /> <br />All present <br /> <br />and the following voted against the same: <br /> <br />None <br /> <br />WHEREUPON I said Resolution was declared duly passed and <br /> <br />adopted. <br /> <br />-2- <br />
