WHEREAS. the Village Council deems it necessary and expedient to grant authority to the Village Attorney to commence eminent domain proceedings against all owners of property with whom the Village cannot negotiate easements, NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF ROSEVILLE, MINNESOTA, AS FOLWWS: 1) That the Village Council hereby deems that it is necessary and convenient that perpetual easements be acquired by the Village by condemnation over all property where it is necessary to obtain said easements, in the event said easements cannot be obtained by direct negotiations with the property owners. 2) That the estate to be acquired in the properties is a perpetual easement for constructing, maintain~ng, operating and repairing storm sewer mains, pipes and appurtenances over and across said property, together with ingre s sand egre s s. 3) That the Village Attorney be and hereby is instructed to institute the necessary proceedings in condemnation under the power of eminent domain in the name and in behalf of the Village of Roseville, Minnesota, to acquire perpetual easements across all properties where easements cannot be acquired by direct negotiations with the parties, and the said attorney is further instructed and directed to take all such steps as may be necessary to carry said proceedings to a conclusion. 4) That the Village Attorney is hereby given authority to determine when negotiations cannot be consummated and he is further given authority as to the time in which condemnation proceedings should be instituted thereafter. The motion for the adoption of the foregoing resolution was duly seconded by Member Grauel , and upon a vote being taken, the following voted in favor of the resolution: All present and the following voted against the same: None WHEREUPON I said Resolution was declared duly passed and adopted. -2-
