<br />WHEREAS, the statutes of the State of Minnesota state <br />that the Village has the power and authority to take and <br />acquire said properties by condemnation under the power of <br />eminent domainj <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Village Council <br />for the Village of Roseville, Minnesota, as follows: <br /> <br />The Village Council hereby deems that it is necessary <br />and convenient that perpetual easements over the properties <br />described in the easements listed below be acquired by the <br />Village by condemnation, said properties to be acquired <br />being described in the following easements: <br /> <br />Easement No. 1036 <br />Easement No. 1251 <br />Easement No. 1271 <br />Easement No. 1288 <br /> <br />Said easements being a part of Sanitary Sewer <br />Improvements Nos 1 and 2. <br /> <br />That the estate to be acquired in the properties <br />described in the easements set forth above are perpetual <br />easements for constructing, maintaining, operating and <br />repairing sanitary sewer mains, pipes and appurtenances <br />over and across said properties, together with ingress <br />and egress. <br /> <br />That the Village Attorney be and he hereby is <br />instructed to institute the necessary proceedings in con- <br />demnation under the power of eminent domain in the name and <br />in behalf of the Village of Roseville, Minnesota, to acquire <br />the properties described in the easements set forth above <br />under the statutes of the State of Minnesota, and the said <br />attorney is further instructed and directed to take such <br />steps as may be necessary to carry said proceedings to a <br />conclusion. <br /> <br />The motion for the adoption of the foregoing <br />resolution was duly seconded by Member Curley , and <br />upon a vote being taken, the following voted in favor of <br />the resolution: <br /> <br />All present <br /> <br />and the following voted against the same: None <br /> <br />WHEREUPON, said resolution was declared duly passed <br />and adopted. <br /> <br />-2- <br />
