WHEREAS, the statutes of the State of Minnesota state that the Village has the power and authority to take and acquire said properties by condemnation under the power of eminent domainj NOW, THEREFORE, BE IT RESOLVED by the Village Council for the Village of Roseville, Minnesota, as follows: The Village Council hereby deems that it is necessary and convenient that perpetual easements over the properties described in the easements listed below be acquired by the Village by condemnation, said properties to be acquired being described in the following easements: Easement No. 1036 Easement No. 1251 Easement No. 1271 Easement No. 1288 Said easements being a part of Sanitary Sewer Improvements Nos 1 and 2. That the estate to be acquired in the properties described in the easements set forth above are perpetual easements for constructing, maintaining, operating and repairing sanitary sewer mains, pipes and appurtenances over and across said properties, together with ingress and egress. That the Village Attorney be and he hereby is instructed to institute the necessary proceedings in con- demnation under the power of eminent domain in the name and in behalf of the Village of Roseville, Minnesota, to acquire the properties described in the easements set forth above under the statutes of the State of Minnesota, and the said attorney is further instructed and directed to take such steps as may be necessary to carry said proceedings to a conclusion. The motion for the adoption of the foregoing resolution was duly seconded by Member Curley , and upon a vote being taken, the following voted in favor of the resolution: All present and the following voted against the same: None WHEREUPON, said resolution was declared duly passed and adopted. -2-
