<br />WHEREAS, the statutes of the State of Minnesota <br />state that the Village has the power and authority to <br />take and acquire said properties by condemnation under <br />the power of eminent domain; <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Village <br />Council for the Village of Roseville, Minnesota, as <br />follows: <br /> <br />The Village Council hereby deems that it is <br />necessary and convenient that perpetual easements over <br />the properties described below be acquired by the Village <br />by condemnation, said properties being situated in the <br />County of Ramsey and State of Minnesota, to-wit: <br /> <br />TRACT NO. 1 (Easement W-704) <br /> <br />The Northerly 7~ feet of Lot 1, Block 4, <br />Roseville Heights, according to the plat <br />thereof on file and of record in the office <br />of the Register of Deeds of Ramsey County, <br />Minnesota, together with a temporary <br />construction easement, 5 feet in width lying <br />Southerly of and immediately adjacent to the <br />aforedescribed perpetual easement. <br /> <br />The said perpetual easement to be 7~ feet <br />in width. <br /> <br />TRACT NO. 2 (Easement W-705) <br /> <br />The Southerly 7~ feet of Lot 7, Block 5, <br />Roseville Heights No.2, according to the <br />plat thereof on file and of record in the <br />office of the Register of Deeds of Ramsey <br />County, Minnesota, together with a temporary <br />construction easement, 5 feet in width lying <br />Northerly of and immediately adjacent to the <br />aforedescribed perpetual easement. <br /> <br />The said perpetual easement to be 7~ feet <br />in width. <br /> <br />-2- <br />
