Willmus Properties, Inc. for a special use permit <br />to extract sand and gravel from property lying between Dale Street and Western Avenue <br />north of County Road C be denied. Motion carried. Soike abstained. <br /> <br />File No. 143 - George E. Tschida application to subdivide lot known as 1890 N. Hamline <br />Avenue into two lots. George E. Tschida and wife, 1890 North Hamline Avenue attended <br />the meeting. <br /> <br />Membrez Moved, Soike Seconded, that we recommend to the Village Council that the <br />Tschida request be granted contingent on his submitting a 10 foot easement to the <br />Village for the widening of Hamline Avenue. Carried unanimously. <br /> <br />File No. 144 - Application from E. B. Isaksen to rezone land from 8-1 to B-3 located <br />near Snelling Avenue and County Road C 2. E. B. Isaksen, 3426 Glen Arden Court attended <br />the meeting. <br /> <br />Mr. Isaksen furnished the following legal description when submitting his application <br />for rezoning the land: <br /> <br />"Lot 7, Block 2, Prop. Loc. 3 So. 50 ft. Rosette and <br />Lot 6, Block 2, Prop. Loc. 3." <br /> <br />The description was used in mailing of legal notice for our meeting. It appears that <br />the description was intended to read "Lot 6 and the South 50 feet of Lot 7, Block 2, <br />Rosette". The difference in wording of the legal description caused some doubt in the <br />legality of the public hearing. <br /> <br />Jonason Moved, Motl Seconded, that if it is the op1n1on of the Village Attorney that <br />the legal description is adequate and covers the property that we recommend to the <br />Village Council that the rezoning of land from B-1 to B-3 by Mr. Isaksen at the location <br />near Snelling Avenue and County Road C be denied. Carried unanimously. <br /> <br />File No. 145 - Application from Warren J. Brennan for a special use permit to build <br />apartment buildings in a B-1 District at Harnline Avenue and Highway No. 36. <br /> <br />Warren Brennan, 3093 Churchill Street desires to build two - 24 unit apartment buildings <br />in a B-1 District. <br /> <br />Membrez Moved, Grauel Seconded, that the request of Warren Brennan for construction of two <br />-24 unit apartment units be recommended to the Village Council for approval as per <br />Drawing No. 1727-8 dated May 24, 1963, as submitted with the condition that a 60 foot <br />strip of land be dedicated for a collector street and be graded and constructed according <br />to Village specifications. The north line of this 60 foot strip of land shall not be <br />less than 315 feet south of the south right-of-way line of Trunk Highway No. 36 and run <br />between Albert Street and Harnline Avenue. Carried unanimously. <br /> <br />File No. 146 - Application submitted by Louis J. Borash to vacate Judith Avenue from <br />Churchill to Oxford Streets. Mr. Borash did not attend the meeting. The application <br />submitted by ~fr. Borash did not list any reasons for vacating Judith Avenue. <br /> <br />Membrez Moved, Jonason Seconded, that we recommend to the Village Council that the <br />request to vacate Judith Avenue from Churchill to Oxford Streets be denied. Carried <br />unanimous ly. <br />
