<br />Planning Commission Minutes <br />Regular Meeting, September 4, 1963 <br />7:40 p.m. to 11:05 p.m. <br /> <br />Chairman Jonason called the meeting to order. Commissioners Grauel, Jonason, <br />Lund, Membrez, Motl, Sigford and Soike were present. Councilman Schrenker, <br />Engineer Hanson and Planner Dahlgren were also present. <br /> <br />File No. 149 Bee-Dale, Inc. Application to rezone land from R-l to B-1 <br />near Rice Street and Highway No. 36. Robert Gearin, attorney, advised that the <br />applicant has an easement from Rice Street to the property which is 30 feet wide. <br /> <br />Barney Schmig owns the adjacent property to the north and is interested in selling <br />all his property and not just a portion of it. <br /> <br />Dahlgren advised Mr. Gearin that the ordinance states that property which is <br />served by a private driveway (in this instance 30 feet wide) would restrict the <br />owner from selling any of the adjoining land until a street with a full width of <br />60 feet is dedicated. Mr. Gearin will determine if Bee-Dale, Inc. wants to proceed <br />on that basis. <br /> <br />Soike. moved, Grauel seconded, that the matter be continued at our next meeting. <br />(." r <(", <<'. d. ~\ /V"-.. <>. ;.... ,...... ,-. ~'- .." \'1 <br />File No. 154 - Kermit Foss and Olga Foss, application to rezone lot at 965 Sherren <br />Street from R-l to R-2. <br /> <br />Harold Shear, attorney, and Kermit Foss attended the meeting. Lot 6, Block 1, <br />Hamm-Helsi Addition has 82 feet of frontage and a depth of 337 feet or a total area <br />of 27,634 square feet. The duplex on the property was constructed in 1954. <br /> <br />Myron Jenson, 978 Sherren Street and Clifford Lund had no objections to rezoning <br />the lot. On file, we have a petition containing the names of 14 adjacent property <br />owners who were in favor of the rezoning. <br /> <br />Motl moved, Sigford seconded, that we recommend that the application for rezoning <br />be denied on the basis that the legalizing of such a duplex would create a spot <br />zoning in a single family residential district. Carried unanimously. <br /> <br />File No. 155 - Michael R. Tschida, Bernard J. Tschida and Clifford Lund petition to <br />vacate portions of Albermarle Street and alley north of Elmer Street. Clifford Lund <br />attended the meeting. <br /> <br />Motl moved, Sigford seconded, that the Secretary confer with Mr. Bell about the <br />legal aspects concerning this petition in relation to the law suit and be prepared <br />to give an oral report at the next meetin~. Carried unanimously. <br /> <br />Secretary's note: It is the opinion of the Village Attorney that the Planning <br />Commission should assume the position that the Village will be successful in winning <br />the pending court case and that no apartment buildings will be built on the property. <br />With this in mind, the members of the Planning Commission should determine whether <br />or not the alley will serve a purpose. <br />
