<br />-2- <br /> <br />of the entire area extending to County Road Do The Council, therefore, ordered <br />Midwest Planning to make such a study which at this moment is not yet completed. <br />Under these circumstanceso Nelson moved, Soike seconded, to recommend that the <br />request be denied and inform the Council the reasons for this recommendation. <br /> <br />I. There is a problem in the handling of the surface water in this area. <br /> <br />2. The council ordered a report from Banister Engineering firm on the <br />drainage question. This report was submitted and it states that it is <br />not possible to adequately appraise the drainage problem without additional <br />delineation of the future land use question in the drainage area. <br /> <br />3. The council has also requested the Village Planner to prepare a study of <br />the land use problem as it relates not only to the property in question <br />but the area generally to the north up to County Road Do <br /> <br />4. When the land use study has been completed, the engineering consultants <br />will be in a position to make more precise recommendations regarding the <br />drainage as shown within the boundaries on the proposed plan submitted by <br />Banister. <br /> <br />s. It wase therefore, the opInIon of the Planning Commission to deny the <br />request at this time and reapply again when the overall land use pattern <br />report and drainage solution report are completed. <br /> <br />Motion carried by a unanimous vote. <br /> <br />File 64-240 Sheehy Rezoning = Dellwood Avenue between County Road C=2 and Josephine <br />Road from R-l to R-2 and R-3. <br /> <br />Mr. Rahn representing the ownero Cyril Sheehy, had originally submitted this rezoning <br />petition on December 20 19640 and again on December 14th and January 69 1965. The <br />matter was laid over these many times because of lack of information on the soil <br />condition and storm drainage in this area. There was also considerable opposition by <br />the majority of property owners within 250 feeto Public Works Director Odland said <br />that a 42 inch pipe line should be installed before Dellwood Avenue is improved and he <br />also read the soil test report which did not prove conclusively that single family homes <br />could not be built in this location. It was finally moved by SigfordD seconded by Lund <br />that we recommend that the request be denied for the following reasons~ <br /> <br />I. It was suggested by the petitioner that the principal reason for the rezoning <br />is the poor soil condition reported to exist in this areao It was requested <br />by the Commission that factual data regarding the soil condition be submitted. <br />The tests were submitted but they failed to show conclusively that single <br />residences cannot be built in this platted areao <br /> <br />2. It has been recommended by the Village Engineering Department that a storm <br />sewer line 42 inches be installed before Dellwood Avenue is improvedo The <br />property owners within the area stated they could not stand another assess- <br />ment for storm sewer at this time. <br /> <br />3. There was a concern about the construction of apartment buildings on this <br />property which is surrounded by single family homeso except to the east, not <br />yet developedv but zoned R-I. This could be construed as spot zoning. <br /> <br />Carried by unanimous vote. <br />
