Roll Call, Ayes: Carpenter, <br />Pope, Eagles, Edlund, Membrez. Nays: None. <br /> <br />Planning File 535-~9 - George Reiling request for preliminary plat (Kimberly Park) at Heinel <br />Dr1ve and Dale Street. <br /> <br />TI\ere was no one present for this matter. TI\erefore, it was laid over for the September <br />Planning Commission meeting. <br /> <br />Plannin~ File 536M69 M Michels Construction Company request for variance to division of a <br />lot at o~, Lyd1a Court. <br /> <br />Presentation <br /> <br />Mr. James Michels, representing the tvlichels Construction Company, stated that he is request- <br />ing two variances; namely, a sideyard variance for Lot 17, and a variance to the size <br />(square footage) on Lot 18. Mr. Hichels indicated that in 1966 when he built the house on <br />Lot 17 an error was made in designating the west property line. He stated that he did not <br />discover this error until some time later and that now he is requesting these two variances <br />so that he may proceed to build the house on Lot 18. <br />~1r. Dan McCulloch, owner of Lot 17 on Lydia Court indicated that he was opposed to any of <br />these variances and would request that he be granted his necessary 10 foot setback. <br />Mr. McCulloch explained the history behind the development of this stiutation. <br />Mr. Lowell Odland, 3073 Lydia Court indicated that he thought variances were granted due to <br />hardships and that the only hardship in evidence here was on the part of ~1r. McCulloch and <br />thc rest of the neighborhood. <br />The Planning Commission seemed to feel that the problem was between Mr. McCulloch and Michels <br />Construction Company as to a solution to this mattero <br /> <br />Re c ommen da t ion <br />. <br /> <br />Pope ~foved, Eagles Seconded, that the request for the two variances at 3077 Lydia Court by <br />Michels Construction Company be approved, subject to the two parties (Mr. McCulloch, owner <br />of Lot 17, and Michels Construction Company, owner of Lot 18) reaching a mutually satis- <br />factorily agreement as to the setbacks. Roll Call, Ayes: Carpenter, Pope, Eagles, Edlund, <br />Membrez. Nays: None. <br /> <br />Eagles ~foved, Edlund Seconded, that the meeting be adj ourned at 12: 20 A. M.
