<br />- 5- <br /> <br />Recorrunendation <br /> <br />Mr. Membrez moved and Mr. G. Johnson seconded, that the Camnission recomend approval <br />of Thomas Wi llmus, request for rezoning from I-I to B-3 at 1841 Oakcrest with the <br />condi tion that the setbacks for the building and parking lot fran Fairview Avenue <br />comply with the I-I zoning district setback requirements. Roll Call, Ayes: Demos, <br />Eagles, Kellett, G. Johnson, V. Johnson. Membrez and Pope. Nays: None. <br /> <br />Planning File 767 - Marie Slawik request for rezoning from I-I to B-3, Special Use <br />Permit, Division of lot and Variances at 2691 North Snelling Avenue <br /> <br />Presentation <br /> <br />Mr. Bob Brown, architect, indicated Mrs. Slawik proposed to rezone approximately 5.7 <br />acres on the northwest corner of the intersection of County Road C and Snelling Avenue <br />for the construction of a Grand Avenue Ford car dealership. He stated that at this time <br />it is tmknown what type of development would occur to the north on the remaining 12 acres <br />that Mrs. Slawik owns. <br /> <br />Mr. Dahlgren indicated that the owners of the Rose Theatre located across Snelling <br />Avenue have proposed to the State Highway Department a change in the interchange de- <br />sign of Cotmty Road C and Snelling from a folded diamond concept to a button hook <br />design. Mr. Dahlgren indicated that the Highway Department has stated that they would <br />have a decision as to their feelings on this change in the next two weeks. If this <br />change were approved, the Highway Department would most likely be interested in review- <br />ing the interchange design on the western side of Snelling as well, which would mean that <br />the right-of-way needs and the potential for development would be changed. Mr. Dahlgren <br />camnented that Roseville had approved the improvement of Snelling Avenue in 1971, and that <br />to take action on a rezoning for development would be breaking faith with the Highway <br />Department. <br /> <br />Discussion <br /> <br />Mrs. Slawik indicated that she has waited long enough and stated that she gets no place <br />in her communications with the State Highway Department. She wants to develop and <br />bring property taxes into the Village. <br /> <br />Carl Cummings, representing the owner of Grand Avenue Ford, indicated that time was of <br />the essence. We have waited many months. He suggested that the easiest and quickest <br />way was to approve the rezoning :immediately and let the State Highway Department make <br />their decisions. <br /> <br />Mrs. Demos stated that it would seem that we could wait until the August 1, Planning <br />Camnission meeting to provide the Highway Department one last chance to make their <br />decision as to whether or not they were going to purchase the right..of-way or change the <br />design of the interchange. <br /> <br />Mr. North read portions of a memo from the District #9 State Highway Department Engineer <br />to the Director of Right of Way Operations for the State Highway Department which <br />indicated that the District #9 engineer recommended that in order to eliminate the <br />acquisition of developed property and to protect the state from paying for developed <br />property that the area required for highway purposes be acquired at this time. <br /> <br />Mr. Membrez thought that some action should be taken at this time. <br />
