<br />-5- <br /> <br />Mr. Rukavina stated that if the building was actually used by the maximum capacity of <br />480 people, that the parking provided would be very tight. <br /> <br />Mr 0 North suggested that a legal opinion should be obtained on whether a permanent joint <br />parking agree:rrent would be required since the 30 spaces on the Polar Food property are <br />used to :rreet the total parking require:rrents prescribed by the City ordinance. <br /> <br />Mro Rukavina suggested to the KC representative that it would be wise if a Polar Food <br />representati ve could be present at the Council hearing. <br /> <br />Mr 0 SiIIDns stated that he foresaw potential overflow parking fran the European Health <br />Spa and the King's Court. He was not sure what this impact would be and whether or not <br />it would have an effect on the KC parking lot. He voiced concern that the entrance and <br />exit fram Snelling to the service road would certainly be a very hazardous situation. He <br />stated that he did not want to vote "no" on the application, but that he was concerned <br />about voting "yes" because he did have reservations. <br /> <br />Mr. Rukavina stated that if the City Council could be satisfied about the resolution of <br />the parking problem on the property that he cculd feel positive about the application. <br /> <br />Mrs. CUshing indicated that the entrance and exit onto Snelling would be used primarily <br />by traffic from the KC operation when the traffic on Snelling Avenue was lightest. <br /> <br />Mr 0 SiIIDns indicated that rruch of that traffic, however, would be during the dark hours <br />of the evening. <br /> <br />Reccmrendation <br /> <br />Mr. Rukavina rroved and Mrs. CUshing seconded, that the Coomission reccmrend approval of <br />Nazareth Building Association! s request for variance to parking setback at 2555 North <br />Snelling Avenue with the following conditions: <br /> <br />1. That the Joint Parking Agreerrent with Polar Food lDcker be completed <br />as a permanent. agree:rrent, <br />20 That adequate sidewalk be provided fran the Polar Food lDcker parking lot to <br />the principal entrances of the KC building 0 <br />30 '!hat the applicant work with the City staff in designing the berming and screening <br />on the west end of the parking lot adjacent to Fry Street. <br />4. '!hat the outdoor lighting be directed so that it affects only the KC property. <br />5. That the sidewalk be constructed, as required by ordinance, adjacent to Oakcrest <br />and Fry Street 0 <br />6.
