<br />-2- <br /> <br />Reconmendation <br /> <br />Mr. Kellett rroved and Mr. Mastel seconded, that the Ccmnission recorrnerrl approval of the <br />platting of 5 lots between Dellwood and Fem~ on the sooth side of lake Josephine, <br />subject to the corrlitions that lot 5 be held for ponding and drainage purposes and the <br />developer dedicate the north 20 feet of said lot for a utility easenent. Nays: None. <br /> <br />!:,lanning File 1051 - Ed Cave & Sons request for preliminary plat, rezoning iran R-l to <br />R-2 and variance to front and side yard setback at 2000 County Road D <br /> <br />Presentation <br /> <br />Mr. Sam Cave, President of Ed Cave & Sons, irrlicaterl that he would like to plat a long <br />narra-.r strip of land. i.nnediately to the west of an area that he platted last year. The <br />lots would be substantially the sane size, however, in order to put a slightly larger hare <br />on the lots, he is requesting a variance to 8 feet for side yard setbacks and 25 feet for <br />front yard setbacks. Also, he indicated that he would like to rezone to R- 2, the four <br />comer lots at the intersection of Brenner and fuunt Ridge Road. <br /> <br />Mr. Havard Dahlgren reviewed the past zoning and platting matters that have happenerl. in <br />this area and indicaterl that although these lots are smaller than that indicaterl in our <br />cooe, it has been the trend in the past years in this particular area to go to smaller lots <br />and reduced setbacks. <br /> <br />Discussion <br /> <br />Mr. Rukavina asked if it was -<-the intent of the developer to develop all the lots with an:' <br />8 foot--setback on each sideyard. It was indicated that this was not the intent, havever, <br />the developer did wish to have the ability to do this in those instances where it would <br />provide a ITOre attractive hare to the buyer. <br /> <br />Mr. Dave Nelson, 2031 Brenner, questioned the indication of hardship in applying for the <br />variances and requested that the rezoning to R- 2 for the 4 lots requested be delayed due <br />to the unknowns, expeciall y as they related to the impact on the hares already builtin <br />the area. <br /> <br />Mrs. Arrlerson indicaterl that as all the existing hares on Brenner are built at the 30 foot <br />setback to allow the comer hones at the intersection of Brenner and MJunt Ridge to be <br />built at a 25 foot setback, would not be in conformance with the rest of the hares. She <br />asked that the Planning Conmission recomrend a 30 foot setback from Brenner Avenue. <br /> <br />Tan Beneke, 2011 Brenner, presenterl a petition to be forwarderl to the City Council of <br />people in the area in opposition to the rezoning fran R-l to R-2. <br /> <br />Mr. Mastel asked that should the Planning Comnission or Council deny the R- 2 zoning, <br />would the contractor construct single family hares instead and. it was indicated he would. <br /> <br />Mr. Sirrons indicaterl that as long as the property to the SQlth of this developnent was <br />as yet undeveloped and could possibly be develope:1 as apartments, he could see the <br />possibility of rezoning the south 2 lots to R-2, havever, he felt that theoretically at <br />least, the two north lots should remain R-l. <br /> <br />Feccmrendation <br /> <br />Mr. Kellett ITOved and Mrs. Cushing seconded, that the Carmission recarmend approval of the <br />preliminary plat and variances to front yard and side yard as requested for those setbacks <br />that apply to M:>unt Ridge Road.
